GEO. 18

「養和」即 The Yeung Wo Nursing Home,20 21 英文報作 Young Wo/Yeung Yiu/Yeung Wah,皆 OCR 異體,本論文一律印作「養和」。

11 40 因「acted in opposition to the advice given by the majority」,依《皇室訓令》第十二段須書面報告。

The Happy Valley Murder and the Governor’s Pardon

George Fung, the hired assassin, and the trial of Cheng Kwok Yau, Hong Kong, 1932–33

Abstract

On the evening of 24 March 1932, about 8.30 p.m., George Fung (馮德謙, alias 佐治 / Fung Him / 馮謙) was shot from behind at the mouth of Yick Yam Street on Village Road, Happy Valley, while walking with the Shanghai actress 黎明暉 (Lai Ming Fai, the press’s “Miss Fay Li”). He died within half an hour at the Yeung Wo Nursing Home. The gunman, “the Shanghai man” Wong Nam Sheung, was only the end of a chain: the wealthy young man Cheng Kwok Yau (鄭國有) had procured the murder through his chauffeur Lau Hing and a second chauffeur, Chui Yung Shom, for a $2,000 reward. A Supreme Court jury convicted Cheng of counselling and procuring murder on 24 August 1932 after forty minutes’ deliberation; sentence of death followed on 14 September. Sir William Jowitt K.C. argued the Privy Council petition on 13 December 1932; it was dismissed without Crown reply. On 12 January 1933 the Executive Council advised 7–2 against clemency; on 19 January, 5–4. Governor Sir William Peel nevertheless commuted the sentence to imprisonment for life, announced 20 January, reporting under paragraph XII of the Royal Instructions on 3 February. The Administrative Report for 1932 called it “of the very rare kind in which the murderer directing a hired assassin is brought to justice.” This paper reconstructs the full chain from the two CO 129 files (541-10 and 541-11), the three English dailies of 1932–33, and the 工商日報 image series, correcting every point of the earlier six-bullet pass.

1. The scene and the identification

The Daily Press of 25 March 1932 led with “MR. GEO. FUNG SHOT IN VILLAGE ROAD”: the deceased was walking arm-in-arm with Miss Fay Li when he was shot from behind; Dr. S. C. Ho, leaving the nursing home, heard the shot and the whistles and attended him. 15 The post-mortem of 25 March found a bullet wound at the back of the chest below the left scapula, 5 mm; death from haemorrhage and shock. 17 The China Mail of the 26th reported the funeral (noon, the Chinese Permanent Cemetery) and that the wanted man had been traced. 16

The brother, Fung Chung, learned of the death at nine and went to the nursing home: 「三月廿四號晚九時吾知其被害,前往養和院察視,則其已斃命」. 18 19 The father, Fung Shui Wa (馮少華), was the compradore of the Wicking firm (域成洋行); the equation with Harry Wicking & Co. is an inference between two records of the same man, flagged as such and never asserted. 18

The nursing home is 養和 — The Yeung Wo Nursing Home, opened 1922 — with the English forms “Young Wo,” “Yeung Yiu,” “Yeung Wah,” “Yang Wo” all OCR variants of the same name. 20 21 The street names are bilingual: 奕蔭街 (Yick Yam Street), 山村道 (Village Road), 黃泥涌 (Wongneichung, as the indictment prints it). 1 23 27

2. The triangle and the chain of hire

Lai Ming Fai (黎明暉, b. 1909, d. 2003) was a Shanghai film actress and singer who came south with her father’s theatrical troupe (the Daily Press dates this 1928, the ksyp 1929 — K2). 24 25 The accused lived with her “as husband and wife in appearance”; the record is explicit that she was a virgin; marriage was agreed but deferred 「待被告廿一歲而後結婚」. 3 27 Lindsell’s opening makes the same point. 60

In February 1932 the triangle closed: Fung took a room for her at the Nathan Hotel; on the 24th she handed back her jewellery at the Hong Kong Hotel; the accused replied that he would “never let the two live happily together.” 28 The ksyp’s account of the same scene differs in staging (Repulse Bay tea-dance + a servant with a letter) — same transaction, two tellings (S3). 27

The chain ran through the chauffeurs: Lau Hing (the accused’s driver) → Chui Yung Shom (Mr. Gocke’s/Cooke’s private chauffeur) → the gunmen. 2 29 30 On 8 March the three met in Kwa Toi Hotel; observations were kept on Fung. A cubicle in Happy Valley “almost overlooking Village Road” held a firearm. 31 On 19 March an attempt was abandoned without a shot; the accused told Zimmern of the failure on the 20th — the admission the Chief Justice later called practically decisive. 33 34 On 26 March Lau paid $2,000 to Tsui as the conspirators’ reward. 2

3. Committal, Sessions trial, verdict

Arrested 4 April, the accused was first heard at the Central Magistracy on 26 April; the doors were shut after the first comers; the Surveyor-General produced eight plans of the 黃泥涌 and 山村道 streets. 23 27 On 20 June two other men were arrested; by the end of June the evidence of Tsui, Ah To Nui and the public car driver had become available; both turned Crown witnesses under conditional pardons. 59 On 27–28 June Lindsell’s “sensational disclosure” named the principal: Wong Nam Sheung, arrested in Shanghai, extradition awaited. 29 30 “Ah Kwan boarded a tram and departed and the Police have been unable to locate him.” 31 32

The Sessions trial opened 8 August before Chief Justice Sir Joseph Horsford Kemp: “Perhaps never before in the history of criminal trials at the Supreme Court has so much public interest been shown…” 25 37 The China Mail of the 11th carried her photograph: “the beautiful Chinese actress… one of the principal witnesses.” 26 22 Kemp ruled the Zimmern–Christie evidence admissible; the defence called it “perjury from beginning to end.” 61 59

On 24 August the jury returned “Guilty” after only 40 minutes’ deliberation (two papers, same figure — adversarial attempt A1). 4 5 The indictment, quoted in full by the China Mail: “Cheng Kwok-yau, alias Cheng Wan… through one, Lau Hing, did counsel, procure and command Chui Yung-sham and Wong Nam-sheung… to murder Fung Him, alias George Fung.” 39 The foreman was G. S. Archbutt; the one Chinese juror, Kan Tong Fo. 11 The AR’s “trial lasting from 26th April till 14th September” is the whole arc, not the Sessions run — K8. 14

4. Appeal, the Privy Council, two ExCos

On 25–26 August the reserved points were argued: admissibility of Zimmern and Christie, and whether the case should have gone to the jury at all. 61 The Full Court affirmed the conviction on 12 September: Wood P. held the evidence part of the res gestae and called the conviction supported by “convincing evidence”; Kemp C.J. agreed. 41 42 62 Sentence of death was pronounced 14 September; over a thousand were in Court; an application for respite at the bar was refused. 43 6 A respite was later granted for the Privy Council application. 46

Sir William Jowitt K.C. argued the petition on 13 December 1932, submitting “a fundamental miscarriage of justice”; the appeal was dismissed without Crown reply; the sealed Order reached the Government on 2 January 1933. 7 47 8 On 12 January the Executive Council advised 7–2 against clemency; execution was fixed for 24 January. 9 The Daily Press told its readers the petition “must be dismissed” (13 Jan), then printed the petition text itself urging “every success in the worthy enterprise” (18 Jan); 63 the second petition — 「第二次之聯稟簽字者竟達一萬七千餘人」 — was handed in the evening of the 19th. 48 49 The second ExCo advised again against, but only 5–4. 10 The ksyp’s independent account of the day records the betting on his life: 「又日前頗多以鄭之生死為博者」. 50 51

5. The Governor’s pardon

On 20 January 1933 Governor Sir William Peel announced the commutation to imprisonment for life — not a pardon, and not freedom: 50 52 His three considerations, in the despatch of 3 February 1933: the four councillors for clemency; “a plea for commutation submitted by the foreman and two members of the jury that had unanimously found the prisoner guilty”; and “the very serious injury done to the prisoner by the murdered man, creating a state of mind in the former which rendered him very susceptible to the influence of unscrupulous conspirators.” 11 Because he had “acted in opposition to the advice given by the majority,” he reported the facts under paragraph XII of the Royal Instructions; the Colonial Office minute reads: “The Gov. has acted against the advice of the majority & reports the facts required by para XII.” 12 54 The jury’s plea — foreman plus two members, one of them the Chinese juror — survived adversarial attempt A3. 11 14

6. Afterlife: the school and the film

From prison Cheng founded and ran a free school: 「被控主使謀殺馮德謙之鄭國有現被困於獄中… 不收堂費學費」, opened the previous year at 大道西. 55 56 In July the ksyp reported rumours that his mind had given way, and the gaoler’s denial. 57 The case returned as show business: the Oriental Theatre advertised “FAY’S FIRST PICTURE SINCE FUNG MURDER.” 58 Wong Nam Sheung was tried in the Shanghai District Court; his outcome is a gap. 35 Chui and Ah To Nui served the Crown under pardons; 59 Lau Hing “cannot be found in the Colony.” 32 The verdict-day China Mail romanizes the actress “Lai Ming-fai”; the press’s early “Miss Fay Li” is the Daily Press style for the same person. 64 22

7. Conclusion

The Happy Valley murder is one of the best-documented criminal cases in the corpus: near-daily press from 25 March 1932 to 20 January 1933, the trial judge’s complete notes at CO 129/541-11, the clemency file at CO 129/541-10, and a continuous Chinese record in the 工商日報. The headline is not the blood but the machinery: a four-layer chauffeur chain, two tainted witnesses whose evidence survived as res gestae, a forty-minute jury, a Privy Council dismissal, two Executive Council majorities against clemency, and a Governor who used the Royal Instructions’ own reporting clause to act against that advice. The AR’s own verdict — “of the very rare kind in which the murderer directing a hired assassin is brought to justice” — is the citable form; no superlative is added. 13

Every do-not from the register survives: the gunmen’s Chinese characters are never invented (K7); the commutation is never called a pardon (C12); Ah Kwan is never said to have been caught (G4); the execution of 24 January is never dated as having taken place (do-not). The single-witness items (S1–S7) stay labelled; the conflicts (K1–K9) stay unreconciled where the corpus cannot settle them.
