At 2010 on Roth October, being stopped in position 320 degrees, 1.3 miles from the Earth #est corner of Bate Island, I sighted a stemship prosceding into Biss Bay showing only a faint light aft. I had assumed this position instead of that given in Commodore Hong Kong Remo.No.058 of 17th October,1997, so as to be able to sight any craft entering Bins Bay from between Bate Island and the Ɛainland, na well as thorugh the Main Channeλ.
On sighting the steamer I went to Action Stations and took up a position just start the part beam of the steamer which appeared to have used the channel between Bate Island and the
miniand.
When ready I switched on the ten inch searchlight and ordered the steamer to stop instantly by Aldis Lamp. This was not obeyed, I the efore fired a blank round. The steaner did not stop, whereupon I fired a praoties projectile moress her bows, which caused her to stop and alter oourse to starboard. I Book station astern, and about two mirates later I observed the steamer to be going shead at full speed. I therefore fired one practise and one 8.A.P. shell into ber stern which did not stop her. The steamer proseeded at full speed and used helm to try to escape, but after some minutes I prassetat manoeuvred to a position on her starboard bean and fired one 8.A.P. and two H.E shell at her engine room. The last H.E. shell struck the ship just abaft the funnel and below the upper desk, and burst- ing well, out the steam pipe which caused the steamr to slow down gradan117. Shortly afterwards I observed that the ship was on fire aft.
I saw several men juang overboard during the engage- ment and therefore proceeded to pick them up. The first min was evidently a pirate as a clip of pistol ammunition from which two rounds had beer used was found on him.

By this time, about 2045, the steamer which bad been identified us the ́s AIRENE, had lost her way and was burning furiously aft, I proceeded alongside bow to stern so sa to get my sonning tower underneath the fiere of ber bows on the starboard (lse)" side as I could then establish communioa- tion by training my gun påatform on the beam. During this operation one or two shots were fired from the IRFIT but it could not been seen from whence those came.
The embarkation of passengers and crew was rendered difficult by the swell and by the fact that it was not poss- ible to get lines out. The IRENE was yowing considerably and it was with the greatest difficulty that the subum.zine was kept under the bow.
I regret to report that four passengers (three male and one female) lost their lives during this operation, two by drowning and two from falling from the forecastle on to the saddle taris. It was impossible to control the panie among the Chinese.
Having cleared the ship as far as the fire would permit I went matern: and hearing ories on the port side of the IRENE went alongside that side and rescued one chinaman who had became entangled with ropes handing over the side. I then proceeded to pick up some men I had observed in the water to Westward and to recover my berthon Bost.

At about this time, 2218, 8.4.IRFÆR showed a tendency to lie broadside on to the wind, therefore, as this would cause the fire to spread and also she might drift ashore I decided to archor her. This was completed at about $245, I remined songɛide until about 8330 and salved a certain amount of passengers effects which had been left on the forecastle,

matter, if particulars were obtained from
Hong Kong of any cases in which British-
owned ships were seized by Bias Bay
pirates in Chinese waters, with a view
to presenting a claim against the Chinese
Government for the loss sustained through

by the China Merchants Steam Navigation Company against the
commander of His Majesty's Submarine L 4, but he understands
that it was dismissed. He is however advised that the result
of municipal proceedings is not necessarily conclusive on
the question of international liability; and that in this
case it may depend on the grounds on which the action was
dismissed.
Sir Austen Chamberlain will accordingly be glad
if Mr. Secretary Amery will furnish him with a text of the
judgement given in the proceedings in the Hongkong Court,
together with his views as to the reply to be returned to the
Chinese Minister for Foreign Affairs.

STATEMENT
DEFENCE.
1. The Defendant admits the statements in paragraph 1 of the
Statement of Claim.
At all times material to the issues in this action the
Defendant held the rank of Lieutenant in the Royal Navy and was
in Command of His Majesty's Submarine L.4.
The Defendant denies that the sinking of the S.S. "Irene"
was caused by gun fire from or any action of the said Submarine.
The Defendant says that the sinking of the said ship was caused
by fires started by pirates who were in control of the said ship
under the circumstances hereinafter set out.
4. On or about the 19th October, 1927, whilst on the high seas,
and on a voyage from Shanghai to Amoy, the S.S."Irene" was seized
by pirates, her ship's officers overpowered, and the ship's
course altered to Bias Bay, which had been and was at the time a
base for piratical operations. At 8.10 p.m. on the 20th October,
1927, His Majesty's Submarine L.4 was stationed about 1.3 miles
from the Northwest corner of Bate Island. A steamship was sighted
proceeding into Bias Bay and showing a faint light aft but no
navigation or other lights. The steamer subsequently proved to
be the S.S. "Irene", and, at the time, was in the hands of pirates.
The submarine took up a position aBaft the steamer's port beam,
a search light was swtiched, on, and a signal to stop instantly
was made by Aldis lamp. This order was not obeyed and a blank
round was fired by the Submarine. The steamer still continued
continued on her way, but, on a practice projectile being fired
across her bows, she stopped and altered course to starboard.
The Submarine took up station astern, but, about two minutes
later the steamer proceeded ahead at full speed. At this time
the Submarine was under fire from small arms from the steamer.
Two shells (one practice and one semi-armour-piercing) were fired
into the steamer's stern, but she still proceeded at full speed
and used her helm in an attempt to escape. After some minutes
three shells (one semi-armour-piercing and two high explosive)
were fired at the steamer's engine room, the last of which out
the steam pipe and caused the steamer to slow down and eventually
stop. Subsequently the steamer was seen to be on fire aft. There
upon the Submarine came alongside and every effort was made to
save both the ship and those on board, six ship's officers and
226 Chinese being rescued. During this operation the Submarine
was again under fire from small arms.
5. Under the circumstances above mentioned, it was the duty of
the Defendant, as Commander of the said Submarine, to take all
necessary steps to capture the pirates and to gain control of

no more force than was reasonably necessary under the conditions
prevailing.
The Defendant repeats the statements in paragraph 4 hereof
and says if the acts there set out caused the sinking of the
S.S."Irene" the said acts were performed by him by the direction
of the Crown and as an act of state.
The Defendant repeats the statements in paragraph 4 here of
and says that if the S.S." "Irene " was sunk as a result of any of
the acts there set out or by gun fire as alleged in the State-
ment of Claim, the acts of the Defendant which caused the sin-
king of the said steamer-whether by gun fire or otherwise- were
performed by the Defendant as an officer of the Royal Navy and
and a servant of the Crown and such acts have been ratified
and adopted by the Crown as an Act of State.
