Referring to our letter of the 1st August 1921 and your acknowledgment thereto dated 8th August 1921, No.3081/1938, you were informed of the fact that the management of the Hongkong Agency of the Russian Volunteer Fleet was handed over to me by the tormer Agent, Mr. A. A. Koukolevsky, by order of our Board of Directors in Paris.
This Board of Directors of the Russian Volunteer Flest is still functioning with temporary seat in Paris and a Far Eastern Administration in Vladivostok, It was formerly situated in Petrograd under the Imperial Regime
and also there under the Provisional Government of Kerensky
(the last recognised government of Russia). It removed ite sest to Theodosia (South Russia), then to Constantinople,
and then to Paris on account of the Bolshevik persecution.
My power of attorney to represent the Russien
Volunteer Fleet in Hongkong is from the Manager of the Far
Eastern Administration with the sanction of the Board of
Directors in Paris.
I believe it is the intention of our Board of Directors not to return to Russia until such a time as there will be a properly constituted Government recognised by the Foreign Powere.
It has come to our knowledge that there is now in this Colony a certain individual by the name of J. Leonidoff claiming as a Special Delegate for the Russian Volunteer Fleet in the Fer East evidently appointed by another Board of Directors with seat in Moscow under the Bolshevik Jeviet Government.

and "Simferopol", doing some chartering business around the China Coasts and Cochin-China. These vessels are now fly- ing the French flag under a temporary agreement made betw- een the French Government and our Board of Directors in Paris,
Mr. Leonidoff has inserted advertisements in the local presses tending directly or indirectly to interfere with our business; has issued orders releasing Captain Koseradeky of 8. 8. "Indighirks" from services for refusing to recognize him; has ordered that our stemmers should be sent to Russia,

Referring to Viscount Harcourt's Circular #despatch of the 28th April, 1915, and to Mr. Long's Circular 656279
despatches of the 22nd December, 1917, and the 18th October, 1918, I have the honour to forward for your consideration and approval the enclosed Certificate of Naturalization of Mr. Isaac Samuel Perry, together with a Memorial and Statutory Declaration (with two exhibits attached) in support thereof by the applicant and a Statutory Declaration by Sir Catchick Paul Chater with respect to the residence
of the applicant.
There are enclosed further four Statutory
Declarations vouching for the applicant's good character
and loyal ty by the following persons:-

Chater it ms impossible to remedy this defect, I have permitted the two Declarations in question to be countersigned by an officer of this Goverment, r. Philip Jacks, Land Officer, who is well acquainted with Sir C. P. Chater's handwriting, and I submit in addition two further Declarations by Mr. Jacks and Mr. Shenton from which the whole matter will be clear.
Although Mr. Perry is of Turkish national itv his application is therefore strictly governed by section

SHEWET H;-
Your Memorialist'e full name is Isaac Samuel Perry and he resides at No.2 May Road Victoria in the Colony of Hong Kong and carries on business as a General Broker for Messrs. David Sassoon and Company, Limited, Merchants of Victoria, aforesaid.
Your Memorialist was born in the City of Baghdad then in the Empire of Turkey sometime in the year 1855
but your Memorialist has no record of the exact day of
his birth and is of Turkish Nationality.
Your Memorialist is not and never has been married.
Your Memorialist's parents (both of whom are dead)
were Samuel Isaac Perry (your Memorialist's Father) and
Ezizia Perry (your Memorialist's Mother) who were both
of Turkish Nationality until the said Samuel Isaac Perry
in the year 1884 became a naturalised British subject as
shown by the certificate of naturalisation dated the 13th day of November, 1884 and the certificate dated the 4th day of December, 1884, certifying that the said Samuel Isaac Perry had on that day taken and subscribed the Oath prescribed in Section 10 of ActXXX of 1852 of the Government of India, which two certificates are exhibited to your Memorialist's Statutory Declaration in support of this Memorial.
5. Your Memorialist has resided within His Britannic Majesty's Dominions at the Colony of Hong Kong aforesaid since the month of February 1888.
During the last five years of such residence your Memorialist has on three occasions been absent from the said Colony of Hong Kong namely in the years 1917, 1919 and 1920 for the period of from two to three months. These periods of absence were the occasions of making visits, in 1917 to Cheefoo and Shanghai and in 1919, and
1920 to Shanghai only in connection with your Memorialist's health. Your Memorialist does not recollect the exact dates between which the above trips were taken or the actual length thereof respectively but is able to and does say that none of them exceeded three months in
duration.
6. Prior to settling at Hong Kong your Memorialist was resident on the China Coast at Newchwang, Cheefoo and Foochow for 16 years in all.
Your Memorialist is possessed of such a knowledge
of the English language as enables him to read it and to
converse therein fluently.
In the event of this Memorial being granted, your
Memorialist intends to continue to reside in His
Britannic Majesty's Dominions at Hong Kong aforesaid.

The Hong Kong and Shanghai Bank has been informed by Chinese Government that that Goverment is unable to pay £85,500 due November 17th on account of the 1907 Canton-Kowloon railway loan.. As a result the bondholders have the right to take over the entire undertaking. Can authority be given to me to entered (sic) immediately u into negotiations for this Government to take over the whole of the Chinese Government's responsibility to the British-Chinese Corporation? conditionally on:-
(1) its being given complete control of the line; (2) its receiving an undertaking that discriminating
duties on the line will be abolished;
(3) facilities being given for linking up the line
with the Canton-Hankow railway.
The balance of the line is at present £1,368,000,
repayment of this being spread over a period of thirty-five
The Government of Hong Kong has ample resources to meet such a liability and to control the line. If the line were run properly there is every reason to believe
that it would be a profitable undertaking.
The trade of the Colony would benefit immensely by the junction of the line with the Hankow Railway.

to inform you that the Conventio fixing the minimum age of the admission of children to industrial employment has now been partially adopted in this Colony and the Industrial
Employment of Children Ordinance (No.22 of 1922) forwarded
in my despatch No.330 of the 3rd October, 1922, has been
enacted to adapt the Convention to local conditions.
It has not been considered possible to fix
a greater age than that of 10 years as the minimum age fr
the admission of children into factories, 12 years as the
minimum for the carrying of coal and heavy loads, and 15 !
years in the case of any dangerous trades. Other regulations provide for a limitation of the period of work, for an interval of relaxation during the day and
for one day's rest in every seven days.
The Convention concerning the night work
of young persons employed in industry has also been partially adopted in that provision is made that no child under 15 years of age may be employed in an industrial undertaking between the hours of 7 p.m. and 7 a.m.

Draft Conventions adopted by the International Labour Conference, but I consider that this small interference with the industrial life of the Chinese is all that can safely be accomplished at present and the other Conventions must therefore be reported as inapplicable to this Colony.

Hon. Colonial Secretary,
Mr. F. A. Fixon, Postal Commissioner, Poking District, is now down here. He says that he has not the smallest doubt that the Japanese will not withdraw. The Chinese have raised the question of the withdrawal of the Japanese post offices from the Manchurian, railway zone. The Japanese delegates assert that these offices were never contemplated when the agreement was made at Washing- ton. There have also been a number of demands by the Japanese and I gathered from Mr. "izon that there had been considerable friction all round. I told r. Nixon that
I thought that the Chinese were extremely stupid to mix up the railway zone and postal agencies in China proper. I do not think that any honest man could maintain that a Japanese Post Office in a Japanese railway station on e Japanese railmy we on the same footing as a Postal Agenov
in Chine. Mr. Nixon agreed with me and asid that he
thought that the Japanese delegates were quite honest in
saying that they had not considered for a moment that the
railway zone was to be included in their discussions. Mr.
Nixon said however that he believed that the Chinese
wished to break off the negociations, many postal demands
had been made which they did not wish to accept, and that
it might be better to break off the negociations on some- thing which might be made to appear to be a big political issue, rather than on some subject of postal detail. Any how the matter has been referred to Tokyo and the Japanese members of the commission have declared that if the rail- way sone is included in future discussions they will be unable to withdraw from China.
Mr. Nixon also tells me that at a meeting of postal

experts which he attended just before leaving Peking, it was admitted by Mr. Picard Destelan that he had heard nothing whatever from the French and that he did not think that they meant to withdraw. From what Mr. Landry, French Postmaster, Canton, has told me, I know that the French
would rejoice if the negociations with Japan are broken off, as it will give them a perfectly valid excuse for going on doing nothing.
I pass this on for what it is worth, I believe that it will prove to be correct.

I have the honour to inform Your Grace that
I have had under consideration the ruranization of the Sanitary Department of this Government.
The Colony is at the present time in process
of rapid development involving large building schemes and questions of food supply and sanitation, which make great calls upon the Head of the Department,
The internal affairs of the Department here multiplied correspondingly, and I consider it essentia) that the following appointments should be made as early as possible, in order to cope with the increasing volume of work:-
(a) One Assistant Head of Sanitary Department, who will
also act as Secretary to the Sanitary Board. This
post will be filled by a junior officer of the cadet
service, so as to ensure that there will always be an
officer capable of taking up the duties of Hend of
Sanitary Department,
(b) One Chief Inspector, to supervise the outside staff
of the Department, with duties corresponding rough] v
to those of the Chief Inspector of Police, and with an equivalent selerv (£500 to £600 by £25 annual) v).

I recommend the appointment of Senior Inspector Lamble to fill this office. He will reach his present maximum of £480 on the 1st January, 1923. To fill the vacancy thus onused, I recommend the appointment of Inspector McEwen, with the initial salary of the post, £400, on a year's probation, and on condition that he retires in 1924 at the age of 55.
(c) One First Clerk and Assistant Secretary of the
Sanitary Board, to supervise the clerical staff and records, with a salary corresponding to that of the Senior Clerk of the Audit Department (2350 to £450 by £10 annually).
I recommend the appointment of Inspector Davies to fill this office. His present salary is £340 per
I should point out that the post of Assistant Secretery of the Board already exists in theory under the Public Health and Buildings Ordinance, 1903.
I recommend that Mr. Ligores, Overseer, should succeed Inspector Davies as Storekeeper, and since he is not domiciled in England, the appropriate salary for the post would be that of Class II in the Clerical Service, $2000 to $2900 by 100 annually. Mr. Ligores would commence at $2200, as he is at present drawing $1500 plus $600 personal allowance. The Head of Sanitary Department
has nothing but praise for this man's work at the Disinfect
-ing Station. He is well qualified to undertake the duties
of the post.
I regret that these recommendations were
not forwarded in time for inclusion in the Estimates for 1923, but the opportunity for the reorganisation did not arise until the 3rd November, when the late Secretary to the Sanitary Board, Mr. C. M. T. Reynolds, tendered his resignation as a result of an enquiry into his conduct by
a Committee of the Executive Council. I am particularly anxious that the appointmente in question should synchronize as far as possible with this event, and I have therefore caused the officers concerned to be informed that they will be provisionally appointed to their respective posts 98 from the 1st January, 1923, and I should be grateful if you would notify your approval of the proposals by telegraph. A telegram consisting of the one word "Sanitary" would be understood to mean that the proposals contained in this despatch are approved.
I may point out that the proposals involve the actual addition of one post only to the Estimates for 1923, since (a) is provided for under the Cadet Service and the salary of the Secretary, Sanitary Board, ie available for (c).

of Mr. Churchill's despatch No.267 of the 31st August regarding Mr. J. Ingham's passage to England on his retirement.
Previous to the year 1920 Subordinate European Officers were granted free passages when going on or returning from leave, but they were not entitled to tres passages on retirement. This rule was enforced in respect of all officers except the Police, for whom the Captain Superintendent of Police had been providing free passages on retirement without the knowledge of the Government.
Under the Scheme of free passages for all European officers, which was introduced in January, 1920, a free passage is granted on retirement, provided that the officer concerned has completed four and a half years' resident service since his last return from leave; and, if he is permitted to retire before he has completed such term of resident service, the Government contributes towards the
cost of his passage a sum which bears a like proportion
to the total cost of the passage as the period of the

Mr. Ingham received a grant under this rule towards the cost of the passages of his wife and himself,
Mr. Ingham correctly quotes the cases of three Inspectors who were given full passages on retirement although they had not completed the full term of resident service. These passages were granted in 1921, in contravent- -ion of the regulations, before the fact of their non- observance in the Police Department came to the notice of the Government.
With regard to Mr. Ingham's plea of ill- health, the ordinary regulations apply in a cage of invaliding, unless varied by express permission of the Governor. Mr. Ingham did not raise the question of his health until the question of payment for his passages arose, and I was unable to entertain his subsequent application for permission to go before a Medical Board.
Having in view the large salaries now paid to the Police and their special pension privileges, the provision regarding passages is most liberal. I have directed that the particular regulation as to passage on retirement is to be strictly observed.

I have the honour to confirm Mr. Severn's telegram of October 30th announcing the death of Prison Tarder H. D. Hoare on October 26th.
He was admitted into the Goverment Civil Hospital on the 9th October, suffering from fever, and at first progressed favourably, but then showed signs of general blood poisoning.
On October 26th he showed signs of pulmonary
embolism, and died on the same day.
His general condition had not given rise to any serious alarm till the pulmonary condition suddenly set in on the day of his death,

Hoare, the mother of the docensed officer.

I have the honour to inform Your Grace that
Dr. Rodriguez, the new Governor of Macao, is expected to take up office early in the new year.
In accordance with the established custom
he will no doubt pay me an official visit soon after his assumption of the administration and it will be necessary for me to return the visit in person. I have therefore to request permission to be absent from the Colony for that purpose at such date as may prove most convenient.
As these exchanges of visits are unavoidable whenever a new Governor is appointed either to Hongkong or to Macao I venture to suggest that, in order to avoid the necessity of specific reference to the Secretary of State in each case, it might be laid down as a general rule that the Governor of Hongkong may leave the Colony for the purpose of paying official visits to the Govemor of Macao, on the understanding that he will not be absent from Hongkong for more than one night. Absence for even one night would probably be very exceptional.

In this connection I would request reference
to the correspondence noted in the margin which dealt inter
alia with the question of the payment to this Government of the building now referred to. In that correspond- ence this Goverment preferred claims (a) for half the cost of the working of the Postal Agencies in 1910 (b) for the value of the Post

In the enclosure to the Secretary of State's Confidential despatch of 18th July, 1913, it was stated that the Postmaster General hoped to formulate proposals under which this Government would resume control of the Agencies

in China and that it was therefore inexpedient to proceed with the question of the purchase of the buildings at Shanghai and of the fittings at that and other Agencies.
My predecessor enquired in his Confidential despatch of 19th February, 1914, when these proposals were to be expected but no answer was received and, the war intervening, the matter was allowed to remain in abeyance.
5. I would now request that these claims may be revived. I am quite willing to agree to the suggestion of His Majesty's Divisional Architect that this Government should surrender its interest in the building to His Majesty's Goverment but the proposal that the price to be paid should be the value of the buildings as determined in 1910 less depreciation plus interest at an agreed rate appears to me to be unsound.
We have received no rent from the British Post Office for the use of the building since 1911 nor have we been given any share of the rent received by the British Post Office for the letting of the upper half of the premises to a firm of solicitors.
It seems to me that there are two possible methods of determining what payment should be made, (a) that the sale should as suggested by His Majesty's Division- al Architect be made as from 1st January, 1923, this Government receiving the value of the buildings as determin- ed in 1910 less depreciation (or alternatively the present value of the buildings) but that instead of interest, the payment of which would seem to be illogical if the sale is only to be regarded as taking effect from 1st January, 1923 - we should receive a fair rent from the Imperial Post Office for their use of the building since 1st January, 191].

settling what was a fair rent during these years and I would prefer the simpler course (b) - that the sale should

and that this Government should be paid the agreed value of $46,258.51 with interest from 1st January, 1911, to date of payment. I should be prepared to accept interest at the rate of 5% which is considerably below the ordinary local rates.
Similarly with regard to the furniture of the Agencies which was valued at $3,185,65. This also should be regarded as having been sold to His Majesty's Government on 1st Jemary, 1911, and interest at 5% per annum should be paid from that date.
There remains the question of the balance due
in respect of the loss on the working of the Agencies in 1910. It would appear that half the loss, which was the sum to be refunded to this Government, amounted approximately to £3,100 and I am prepared therefore, subject to early payment of the claims of this Government in respect of the buildings in Shanghai and of the fittings and furniture in the various Agencies, to accept the two payments of £1,500 in full settlement of this claim.

I am directed by my Board to place myself in communication with Your Excellency on the subject of the British Post Office Buildings at Shanghai and to request Your Excellency's views as to the manner of disposing of the buildings after they cease to be used for Post Office purposes on December 1st next.
The original Post Office building stands on ground which was leased by the Imperial Government for nine hundred and ninety nine years to the Hongkong Government at a peperoom rent by virtue of an Agreement dated 18th of March, 1875, between Mr. Robert Henry Boyce of Shanghai acting on behalf of H‚M. First Commissioner of Works and Publie Buildings and Sir Arthur Kennedy, E.C.M.G., Governor of Hongkong.
There is al no an extension which stands on ground belonging to HM, Government and rented by the Hong Kong Government at Taels 100.00 per mensen by Agreement dated 6th of December, 1905.
The lease was considered cancelled when the Shanghai Post Office was transferred from the Hongkong Administration to the Imperial Government on January 1st, 1911, from which date the rent ceased to be paid.
In 1917 the British Postmaster at Shanghai terminated his cocupancy of the flat on the upper floor and the premises were leased as offices, with the consent of the Hongkong Government, to Mesure. White-Cooper and Master
who continue to rent them on a monthly tenancy at Taels 150 per mensem, the rent being paid to the Hongkong Government through the British Postmester.

The question now arises in the changed circumstances as to the use to which the land and buildings should be put.
It is possible that the sale of the land will be considered by the Imperial Government as a solution of the problem but as any definite decision is unlikely to be arrived at for some considerable time I have the honour to enquire whether, in the meantime, it is the desire of the Hongkong Government that a tenant or tenants should be found for the whole building.
I was formally approached a few months ago by the Chinese Postal Commissioner at Shanghai as to the possibility of a lease of the buildings being granted to the Chinese Post Office for two years but I have since been infomed that the ides is no longer being considered by the Postal Authorities at Peking.
Very considerable structural alterations would
be required to render the building suitable for business purposes and indeed it is difficult to see how it could be adapted for commercial letting without practical) v rebuild- ing the premises or at any rate spending at least ten thousand Taels on alterations. The supply of office accommodation in Shanghai at present exceeds the demand and it is unlikely that tenants will eagerly present themselves. The rental value of the premises on the basis
of floor area is at the present time not less than Taele 1,500.00 per mensem,
From a commercial stand-point the Post Office
property is very much under-developed and the question must
be considered as to whether H.M. Government should not make
more profitable use of it.
Pending a decision as to the ultimate
disposal of the property, I sugest for Your Excellency's consideration that authority be granted to me to raise the rent of the premises occupied by Messrs. White-Cooper and

With reference to your letter of the 26th September, 1922, I am directed to inform you that pending a decision as to the ultimate disposal of the British Post Office Buildings in Shanghai this Government is agreeable to your proposal that the rent of the premises occupied by Messrs. Thite-Cooper and Master be raised to Taela 200 per mensem and that suitable tenants be obtained for the ground floor when it is no longer required for the Post Office.

With reference to your letter of November 17th, I have the honour to inform you that I have concluded arrangements with the Chinese Post Office whereby the ground floor accommodation of the former British Post Office is to be lessed to them for 12 months as from 1st January, 1923, with option to renew for such period as may be desired by the Chinese Post Office at the expiration of the tem contracted for.
I have also made a new lenge for 12 months with Messrs, White-Cooper Master and Reader Harris for the occupation by them of the first floor accommodation at an increased rental of Taels 200.00 per month. The rent to be paid by the Chinese Post Office, in respect of buildings only, has been fixed at Taels 8,325.00 per annum.
I take this opportunity to transmit for your information, copy of a memorandum by H.M. Crow Advocate advising in regard to the Title in the Site and Property in the buildings.
You will note that in strict law "any build- ings or structure" should on the determination of the losseĘ revert to the lessor, a point which was apparently over- looked by the perties concerned when the Commissioners of His Majesty's Works and Public Buildings acquiesced in the valuation of the buildings in 1910.
The right of reversion having been waived,

BRITISH POST OFFICE SHANGHAI: Memorandum as to Title to, Site and Property in Buildings.
Title Deed No.574, for Lot 581, in the original British Settlement at Shanghai was issued on 16th October, 1862, on the application of The Lords Commissioners of the Admiral ty, and stands in the Land Register in H.B.M. Consulate-General in the name of the "British Jail".
On the 18th March, 1875 The Commissioners of Works
& Public Buildings, by Mr. R. H. Bovce Assistant Surveyor of Works, Shanghai, leased part of the Lot to the Government of Hongkong, by Sir Arthur Kennedy, the then Governor, for 999 veers from the 1st April 1874 at a nominal rent of one Mexican Dollar cent per anmm.
It was provided: "That the tenant shall not assign "or underlet the said premises or any part thereof to any "person or persons whomsoever or use or occupy the said "premises or any part thereof or suffer the same to be used "or occupied otherwise than for the purpose of a British "Post Office without the consent of the said Landlord or his 'successore".
The lease was determinable upon breach of covenant, and it was provided that the Lessees rights including the "claim of the said Tenant his successors or assigns in or to "any buildings or structure of whatsoever description that "may be upon the said ground shall thereupon cease and "determine."
On the 6th of December 1900 The Commissioners of
Works, London, leased to the Government of Hongkong part of
the "Old Gail Lot* (next to that leased in 1875) for a term
of 999 years as from the let of July 1905 at a rent of Taels

On the land leased in 1905 an extension of the Post Office was built at a cost, then, equivalent to £2400.
As the result of an arrangement made between the Post Office and H.M. Office of Works, in London, control of the British Postal Agencies in China, including the British Post Office at Shanghai, was transferred from the Hongkong Goverment to the Imperial Government as from the 1st January 1911.
No deed of assigment or cancellation of the Lesser of 1875 and 1905 was asked for, or executed.
On the 3rd July, 1912, H.M. Office of Works, London, notified H.. Surveyor at Shanghai that, in view of the transfer to the Imperial Government of the control of British Postal Agencies in China, the rent of Ils.1,200 per anmum payable under the Lease of 6th December 1906 by the Hongkong Government was not to be collected, and that rent paid since 1st January 1911 was being credited to the Postmester General London. Nothing was said as to the "peppercorn" rent, at the "nominal rate of ons Mexican dollar cent per annum", payable under the original Lease of 18th March, 1875; as that, of course, had never been demand- ed, or paid.
On the 21st October 1910 the Acting Governor of Hongkong asked for instructions from the Colonial Office
as to whether the Imperial Government was "prepared to take "over the Buildings from this Colony at the value assessed "by Messrs. Tarrant and Morriss,"
The valuation referred to, namely, 846,258.51,
then equivalent to £4,048.0.0, was, in November 1911, recommended for acceptence by the Board's Principal
Assistant in London; but the buildings, however, have not
yet been taken over.
