In continuation of Sir Henry May'a
Confidential Despatch of 16th. April, 1917, I have the honour to inform Your Lordship that a formal application was receiv- -ed on 13th. December, 1918, by the Registrar, Supreme Court, for the filing under section 252 of the Companies Ordinance (No. 58 of 1911) of the documents necessary to enable the Bank to operate in the Colony.
The Acting Manager of the Hongkong Brmch states that it is the intention of the Bank under instruct-
-ions from the Head Office in Peking to build suitable
premises on a prominent site in Queen's Road Central and to undertake all kinds of banking business here. At present, until the conditions of the Companies Ordinance already
referred to are complied with, only such business as can be dealt with by Native Banks including the payment of Chinese Loan Interest Coupons is transacted, with a staff of about
fourteen accommodated in a temporary office in Bonham Strand
East. As the law stands, there is no ground for objection to the proposal.

With reference to Sir Henry May's telegram
of the 25th February, 1918, and subsequent telegrams refer- ring to the cargo discharged ex S. 8. "Tokuyama Maru", which was detained in the Colony in February, 1918, at the request of His Majesty's Ambassador, Tokyo, I have the honour to submit herewith a statement of expenditure incur- red in this connection to the end of 1918, together with covering vouchers for payment.
Such portion of the cargo as consisted of explosives was at first taken in charge by the Military Authorities, and stored in the Military Magazines, but,
as reported in Sir Henry May's telegram of the 10th May,
1918, the requirements of the Military Authorities made it
imperative that other storage should be found. The Colonial
Government accordingly arranged for the lease of a remote
warehouse, known as Rennie's Mills, and the explosives were
removed to this place in June, 1918.
The remainder of the cargo, consisting of
Railway material was landed and stored in the Honghong and Kowloon Wharf and Godom Company's premises until other arrangements could be made. It was found possible in September and October to remove a large quantity of this material for storage on land belonging to the Kowloon

Canton Railway as reported in Sir Henry May's telegram of
the 17th August, and 400 tons of Rails were purchased by the Kowloon Canton Railway for their own use.
The necessary amount has been credited in the account now forwarded, and the Kowloon Centon Railway charges for storage have been made at half the Godown Company's rates.
During this removal by the Kowloon Canton Railway, the surface of the roads over which the heavy rails passed on hand trucks was badly damaged, and required considerable repair by the Public Works Department. The amount involved was 1818.00 for materials and $81.84 for labour, and I have thought it proper to include this amount in the total recoverable from the Imperial Government.
I enclose further for the sake of clearness
a supplementary statement of the account drawn up in an-
other form, showing separately the different amounts which
have been paid out to the various firms and Government
Departments who have been concerned. The expenditure incur-
red as shown in paragraph 4 above, has been included in this supplementary statement but not in enclosure 1.
I have to request that the balance of
$31,094.30 as shown in enclosure 2 may be credited to the
Colonial Government in the usual manner, and I would also point out that, until the material is disposed of, certain charges, amounting to approximately £2,400 are recurring
monthly during the current year.

I have the honour to report that Sir Boshan Wei Yuk, C.M.G., has enquired whether any assistance can
be given to his son, Mr. Wei Ving-look, either to obtain a commission in the Royal Engineers or to get other employment
under the British Government.
Mr. Wei Wing-lock was the firet King Edward Scholar at the Hongkong University, where he graduated in engineering, specialising in electricity. He subsequently spent two years at the Massachusetts Institute of Technology and in 1916 he proceeded to England to volunteer his services for war work. He is now attached to a Chinese Labour Corps in France. He is aged 27. He distinguished himself in athletics while he was at the Hongkong University.
I know Mr. Wei Wing-lock personally and have a high opinion of him. I have much pleasure, therefore, in recommending Sir Boshan Wei Yuk's application for Your Lordship's favourable consideration. Mr. Vei Wing-lock has been instructed to make application in writing to the Under Secretary of State.

With reference to the correspondence
noted in the margin, I have the honour to
enquire whether there is any objection to
the repeal of the Macao Ertradition
Go/29/ Ordinance, 1881, Ordinance No. 1 of 1881.

It will be seen from the correspondence
referred to above that the Macao Extradition Ordinance, 1881, was passed because at the time there was no extradition treaty between Great Britain and Portugal. When therefore the treaty of the 17th. October, 1892, had been concluded, and the Extradition Acts had been applied in the case of Portugal by the Order in Council of the 3rd. March, 1894, it would have been expected that the Hongkong Macao Extradition Ordinance, 1881, would have been repealed or suspended either under section 19 of the Ordinance or by a separate Ordinmce, Indeed it seems possible that section 19 of the Ordinance was inserted for this very purpose. No steps of this kind were, however, taken, though I am unaware of any reason why they should not have been taken.
In a recent Macao extradition case the
Crow proceeded under the Imperial Acts, but the Full Court
decided on habeas corpus that extradition from Hongkong to
Macao is governed by the local Ordinance, which they hold to

have been preserved by the first clause of Article XVII of the treaty. The result of the judgment appears to be that fugitives from Macao may claim here benefit of any defence or limitation which would be open to them either under the Acts or under the Ordinance.
The chief points in which the Ordinance
differs from the Acts are as follows:-

(a). Extradition is not confined to offences
committed within the territory of Macao but includes offences committed on the high seas. (b). There is no provision for the issue of a
warrant of arrest by a magistrate except on an order by the Governor, which cannot be issued until a requisition has been received. (c). The fugative is given the right of appeal to the Supreme Court on the whole case. This is
in addition to his common law right to apply for a writ of habeas corpus.
(d). The fugitive is debarred from raising in the Courts the defence of political offence, and
the decision on this point is placed in the
hands of the Governor in Council.
(e). Desertion from the naval, military or police
force of Macao is an extraditable offence
under the Ordinance.
(f). The extradition crimes added by the Extradi-
-tion Act, 1873, and the Extradition Act,
1906, are not extraditable offences under the
Ordinance, with the exception of receiving
and wounding with intent to do grievous
bodily harm.
It seems both unnecessary and undesir-
-able that there should be a separate system of law for the
solitary
solitary instance of extradition from Hongkong to Macao, and on some of the points on which the Ordinance differs from the Acts the former appears to be inferior to the latter, The differences between the two lists of extraditable offences could be removed by an order of the Governor in Council, but the other points of difference could be dealt with only by amending the Ordinance.
I propose therefore to introduce an Ordinance to repeal the Macao Extradition Ordinance, 1881, altogether, but you may think it advisable that some com- -munication should be made to the Portuguese Government before this is done. I am unaware whether His Majesty's Government have given any undertaking to give any particular notice before repealing the Ordinance.

With reference to Mr. Long's Secret
Despatch of the 17th. October, 1918, I have the honour to offer the following criticisms and suggestions on the details of the proposed scheme as it will affect persons, firme, and corporations carrying on business in Hongkong.
I do not desire to offer any objection to
the proposal to make Singapore the clearing house for the Eastern Colonies and Weihaiwei, and I have informed the Governor of the Straits Settlements accordingly.
I notice that it is not proposed that the scheme should apply to German subjects who are under a German ex-territorial jurisdiction. This is a matter of considerable importance to certain banks in Hongkong, owing to the number
of German subjects who were carrying on business in China
before the war, and I would venture to suggest that the
scheme should if possible be applied to such cases. If it be not so applied, a question will arise as to whether the
German Government will accept responsibility where one or
more of the partners in the German debtor firm resided in Germany. In some cases the head offices of the German firms
were in Hongkong or China, though practically all of them had partners in Germany. One objection to the assumption of responsibility on the ground of the residence of a partner in

Germany would be that the greater part of the assets of the firm might be in China.
The position of branches does not seem to be entirely clear, and this also is a question which probably is of more importance in Hongkong than in the United Kingdom. A British firm or corporation may have offices in Hongkong, the Straits Settlements, China, neutral countries and Germany," and it may have had business relations with a German firm which had offices in some or all of those places before the war. On such a state of affairs the following questions
would arise:-
(a). Would ol aims by or against branches in neutral
countries be outside the schame, although the head offices might be in British or German territory respectively ?
(b). Should the claim by the British firm or cor-
-poration be made as a whole by the head
office, or should separate claims be made by
the various offices ?
(a). Would claims be received against branch
oftices of German fire in neutral or aliied
territory provided that the debtor firm had an
office or a partner in German territory ?
It does not appear whether secured
creditors will be required to surrender their securities, or
whether they will be allowed and required to realise their
securities and to claim or to account for the balances.
Certain creditors in Hongkong hold as security immovable
property in certain foreign concessions in China, and it might be considered more desirable that these securities
should be realised by the creditors.

The Report of the Enemy Debts Committee dis- -cusses the question of exchange between marks and sterling. A question of exchange will also arise in a few cases where the debt was incurred in Mexican or Hongkong dollars. Probably it would be advisable to provide that such debts must be discharged in Mexican or Hongkong dollars without taking into account any variations in exchange between dollars and sterling. It would be difficult in some cases to fix any rate other than the rate on the day of payment. These cases will probably be very few. This should not apply to the payment of the proceeds of the liquidations, The bulk of the proceeds of the liquidations were invested in British War Loan
securities when the dollar was at a lower rate thm at
present, and it would seem that in such cases the payment
should merely be the amount of the market value of the referable securities at the time of payment.
I understand that the scheme does not apply to claims for damages.

Committee propose to continue propaganda on existing
lines for purposes of British Trade. Committee can at reasonable cost translate trade lists etc., reproduce in Chinese address individually and send through the
post to 35,000 Chinese in Chinese territory and 4,000
HongKong. Committee arranging advertisement of bureau Britishers can advertise in up to 60 Chinese papers
through bulletin paying nett cost of advertisement only
Committee translating and checking insertions. This if
developed will give bulletin hold on Chinese Press.
Only Chinese papers which agree to publish bulletin
will be on list for British advertisement. Bulletin
now in touch with about sixty Chinese newspapers.
Coleman's offer weekly article three guineas per week for twenty six weeks accepted. Articles, should show advantages of British trade methods and benefits accruing to China by expansion of British trade. Instruct
