It is found impracticable to frame equitable rules for giving effect to condition No. 6. Impossible to define warwork. Shortness of staff due to war has led in certain cases to overtime and multiplication of duties remuneration for which has been given in different ways such as acting pay under ordinary rules, monthly allowances, bonus, increase of salary. A cadet in the imports and exports department gote part of his remuneration in the form of allowance from war vote whereas in another office he would have the same remuneration under the ordinary rules. With regard to work not connected with official duties it is difficult to for example distinguish between Doctor Lecturing at University and Schoolmaster who is allowed private tuition under terms of appointment. The points in favour of my contention that Widow's pensions in England are payable at the rate of the day when exchange is over 3/- are as follows:- Gou 76 45 44 straits (a) In the Secretary of State's despatch No, 170 of the 27th. August, 1897, the grant of the 3/- rate at a time when the Dollar was much under that rate is referred to as an "Act of Grace" and in the resolution passed by the Legislative Council (which was based on the terme of the despatch) the words "the difference........being made 38387602 good out of the revenue of the Colony" occur. The fixing of the 3/- rate was not therefore in any sense a matter of bargain between the Government and the pensioners. Again it cannot be contended that Ordinance No. 15 of 1908, (by which the Government took over the Fund) with- draw any of the privileges of the pensioners which had been granted by Ordinance No. 30 of 1890, Now had Ordinance No. 15 of 1908 never been passed it is obvious that the pensioners would have been drawing their pensions at the rate of the day, supplemented up to the 3/- rate by Government out of revenue when neces- Bary. No one could justify the suggestion that they would have still continued to draw at 3/- and that the profit on exchange would have been paid into Revenue, when the rate of the day exceeded 3/- I accordingly hold that the law morally (as well as literally) ordains the payments to be made at the rate of the day. If the widows on sterling pensions are suffering that is a matter for separate consideration. 2. In the matter of the various rates 3/-, 3/8 and 4/- for leave salaries and pensions of officers, a ruling of the Secretary of State is also needed. Arguing from the fact that pensions when paid in the Colony are paid in dollars, I am inclined to think that these rates were originally laid down as "guaranteed minimum rates". There is nothing illogical in the contention that officers and pensioners should get the benefit of the rate of the day when it is recollected that the chief reason for the so called rise in exchange is in fact the diminished value of the gold currency. Again, any reference to Sterling Officers is irrelevant: the above rates were fixed long before any such class was contemplated. A.M. I have the honour to transmit for your consideration a plan, showing, cross-hatched in red, a small area on the Northern Boundary of the New Territory which it was recently proposed to lease for reclamation and building. When the matter came to be considered by the Executive Council under the Foreshore and Sea Bed Ordi- -nance, 1901, some considerable doubt was expressed as to whether the Colonial Government had any right to interpose any further reclamation between Chinese Territory and the sea; and it has been found impossible to arrive at any solution without a reference to the map annexed to the Convention of 9th. June, 1898, by which the New Territories were leased to Great Britain. [Ratifications exchanged at London, August 6, 1898.] WHEREAS it has for many years past been recognized that an extension of Hong Kong territory is necessary for the proper defence and protection of the Colony, It has now been agreed between the Governments of Great Britain and China that the limits of British territory shall be enlarged under lease to the extent indicated generally on the annexed map. The exact boundaries shall be hereafter fixed when proper surveys have been made by officials appointed by the two Governments. The term of this lease shall be ninety-nine years. It is at the same time agreed that within the city of Kowloon the Chinese officials now stationed there shall continue to exercise jurisdiction except so far as may be inconsistent with the military requirements for the defence of Hong Kong. Within the remainder of the newly-leased territory Great Britain shall have sole jurisdiction. Chinese officials and people shall be allowed as heretofore to use the road from Kowloon to Hsinan, It is further agreed that the existing landing-place near Kowloon city shall be reserved for the convenience of Chinese men-of-war, merchant and passenger vessels, which may come and go and lie there at their pleasure; and for the convenience of movement of the officials and people within the city. When hereafter China constructs a railway to the boundary of the Kowloon territory under British control, arrangements shall be discussed. It is further understood that there will be no expropriation or expulsion of the inhabitants of the district included within the extension, and that if land is required for public offices, fortifica- tions, or the like official purposes, it shall be bought at a fair price. If cases of extradition of criminals occur, they shall be dealt with in accordance with the existing Treaties between Great Britain and China and the Hong Kong Regulations. He suffered continually from a serious kidney complaint, and on several occasions during the past year had been a patient in the Goverment Civil Hospital for this reason. After his discharge from the hospital he took short leave of absence, but soon after his return became much depressed, and this appears to have affected his mental balance very considerably. It would probably be a matter of comfort to his relatives to know that Mr. Bideo, who was a Company Sergeant Major in the Hongkong Defence Corps was given an impressive Military Funeral, which was attended by a large and representative gathering. The suggestion to ship away 10 million really took my breath away and such a transaction would lead to a real disaster. note circulation is not confined to the Colony but supplies the currency for the whole of South China and if the reserve was re- duced by shipping away silver coin, leaving only $5 million in our Treasury, the result would be a lack of confidence in our notes, the effect of which would be far reaching and disastrous. In fact our notes would descend to the level of those of the Bank of China. It is due to the strong cash reserves we always maintain that our notes rank so high and I personally would not countenance any reduction whatever in the Silver Reserve held against notes it could not be justified even in such an emer- gency as war finance. As a matter of fact I should very much like to have another $30 or $ 40 lace of silver coin in my Treasuries. For a Bank like ours a cash balance of 40% of o/a Liabilities is none too high. As pointed out in the telegram a shipment of $ 10 million would only have a temporary effect and when that wore off we might be in a very unpleasant position with a large note issue and very little silver against it. At any rate it is a position I have no intention of getting into. The monetary situation here is quite satisfactory but so long as Shanghai keeps in an excited position it is not possible to get to an effective tael level of par with the Mexican dollar nor is it even desirable to do so, especially with Shanghai exchange some 12% above the parity of the fixed price of silver. Par with Shanghai dollars cannot be reached until Shanghai is fully or over supplied with cash. As mentioned in my telegram, it would be an ad vantage to have the option of covering the excess issue by Hongkong & Shanghai Why Curpn. London: depositing securities instead of dollar for dollar at times. It is doubtful if we should have to avail ourselves of the privilege but it is conceivable that an occasion might arise when trade was active and money in demand where our note circulation became inflated and we could not obtain the necessary Silver to deposit against the increase. Under such circumstances permission to deposit securities would enable us to meet the demand without curtailing facilities and bringing trade to a stop temporarily. I would recommend that a limit be placed on the amount of the excess issue to be covered by securities, say $ 3 or 4 millions and such facility should be subject to the special sanction of the Hongkong Government on each occasion. What I wired about the Treasury Chest Officer's require- ments is clear enough and I should think it would suit the Govern- ment to supply the silver and save themselves some 10% on their present monthly finance. * 8 lace is what they require monthly in Shanghai and in the absence of Silver shipments we may not be able to handle it all for them and without our assistance there is no saying what rates they may have to pay. The local requirements are not so great but, if they provided them thro' Shanghai by shipping silver, they would save considerably and the troops would benefit correspondingly by get- ting a lower sterling rate for their pay. Personally I should refuse to consider such a suggestion well realising the disaster to which it would lead and I am glad to say my views are very strongly backed up by the Hongkong Govern- ment. As an instance of Chinese sensitiveness I would mention that a couple of years ago when we shipped a fair amount of coin to India, it was rumoured amongst Chinese that the British Govt. were hard up and had to take the funds of the H. & S. B. C., the result being withdrawal of deposits in Bangkok and an uneasy feel- ing re Bank notes in Swatow and South China generally. Our Note issue is the sheet anchor of the H. & S. B. C. and of the whole of the South China trade and any tampering with the cash reserve would be nothing short of criminal folly. The consequence of any loss of confidence in Hongkong currency would reach far beyond the confines of this Colony and be a real disaster to British interests in the Far East. In any case the stock of dollars here is by no means excessive and I consider that we should not have too much if the balance was $ 50 lace higher. I am quite certain that anyone fully acquainted with conditione in these parts would strongly endorse my opinion. Apart from the above considerations there Hongkong & Shanghai Pkg Burpen: London. nothing in such a transaction to make it attractive even were it not dangerous. At beat it would mean a small immediate profit and leave me without any means of replacing the coin in case of necessity. The dollars would melt in Shanghai at Tls.71 per quantity $100 and to import ́any/from Shanghai could probably not be done under 75 and it is doubtful if any large amount of Mex. dollars could be secured in any case. British and Mexican dollars are the only coins legal tender here. The former can only be ob- tained by minting in India (heavy shipping expenses and 2% seignorage) and the latter are getting scarce, so the Colony might be left without any means of obtaining currency. The contention that the Authorities cannot ask the U.S. to supply silver to China so long as we have a Reserve of $150 lace against our Note issue is truly Judicrous. There is no real surplus mf stock of coin here in fact our holdings should be higher than they are all things considered. Shanghai must look elsewhere than to Hongkong for silver. I hope you will do your beat to remove the false idea that we have too much silver coin in the Colony as nothing could induce me to ship away any coin under existing conditions; to do so would be pure madness. It is very satisfactory to note that in case of necessity any temporary increase in the circulation can be covered by securities in London so long as we have say $100 lacs deposited with the Government. Although agreed to by the Home Authorities it might be necessary to have the ordinance altered as at present it calls for dollar for dollar in the case of excess issue, i.e. Hongkong & Phunghai Toky Corpn. London. the circulation is over $15 millions. However I do not want to change the ordinance at present and in case of urgency the Hongkong Government would no doubt take the responsibility of granting the concession subject to approval from the Home Government should the occasion arise.
