Despatch of the 23rd. of April, I have the honour to transit the enclosed copy of correspondence with the Military Authorities on the subject of the incidence of the cost of enemy subjects intern-
-ed in this Colony.
The total claim is £4,356. 5 1 ond is exclusive of the charges for 76 ilitary prisoners brought here
from Tsingtau.
I am of opinion that the Colony can afford and would be glad to defray the whole cost of all four categories of prisoners mentioned in the Colonial Secretary's letter of the 2nd. of September and if you wish it I will ask the Legislative Council to vote the necessary expenditure.
As the Military Authorities are anvious for prompt payment I shall be glad to learn your decision by telegraph.

I am commanded by the Army Council to acquaint you that they have been in communication with the Colonial Office on
the general question of the incidence of cost of maintenance of
prisoners of war interned in the Colonies, and to state that it
has been decided that the cost of internment and maintenance of
enemy subjects arrested in the Oversea Dominions and Colonies under the authority of the local Government must be regarded as a legitimate charge upon local revenues.
In the case, Lowever, of enemy subjects who are taken into Colonial ports by His Majesty's snips or are removed by the local authorities, in pursunce of the policy of his kajesty's Government, from British merchant slips calling at these ports, sny Colonial Governments that are unable to provide for the ex-
-pense from local revenues, need not be held liable for the con-
-trol and maintenance of these persons. Offers to bear these 1tters charges should not, of course, be lande where Colonial
Governments do not ask for re-imbursement.
The foregoing instructions leave out of considera- -tion the case of prisoners taken in the course of military operation of removed from occupied territory under military authority. If necessery a further communication will be unde to
you in regard to the expenses incurred on account of such prison-

the cost of internment and maintenance of four categories of enemy
subjects, namely:-
(a). Those arrested in the Colony.
(b). Those removed from British merchant ships calling at
the Port.
(c). Those brought into the Port by H..Ships.
(d). Those taken in the course of Military operations and
removed from occupied territory.
I am to request that you will be so good as to
supply a statement showing seperately the expenses incurred in
respect of each of these four categories. His Excellency the
Governor is without nuthority from the Secretary of State for the
Colonies to pay any of these charges and he proposes to address hil
on the subject as soon as he knows what the expenditure involved is.

maintenance etc. of Prisoners of War under the four categories quoted by you, as a general account only has been kept since the

statement of the cost under (a) (b) and (c) collectively, and (d),
but this can only be arrived at by proportion, the numbers of
Prisoners under (a) (b) and (c) being known, also the total cost.

In continuation of my letters of the 30th October, 7th November, 24th November, and 7th December, 1911, and the 1st February and 28th April, 1915, I am directed to convey to you the following further instructions of His Excellency the Governor: ---
German and Austrian Steamers Cargo Committee.
It has been reported to the Government that the above Committee require about $1,000 to defray their expenditure on behalf of cargo owners and that they propose to make an assessment on all persons interested pro rata in order to raise the neces- sary sum.
As the work undertaken by the Committee has been to a considerable extent on behalf of the liquidations of the German and Austrian firms, it is obviously reasonable that the assets of these firms should contribute towards the expenses incurred. The assessment referred to should therefore be paid by the liquidators of such firms as are interested in the cargo in question, and these payments are to be treated as part of the liquidators' expenses.

GENTLEMEN,
In continuation of my letters of the 30th October, 7th November, 24th November, and 7th December, 1914, and the 1st February, 28th April, and 1th lime, 1915, I am directed to convey to you the following further instructions of His Excellency the Governor:-
German and Austrian Steamers l'argo.
As some misunderstanding appears to have arisen with regard to the licences which have been, or can be, issued to bring forward to Hongkong cargo now or recently on board enemy ships sheltering in neutral ports, nist be clearly under- stood that the only two classes of cargo which will be allowed to be brought for- ward are (a) cargo which is wholly the property of British subjects, and thì cargo under lien to a licensed bank.
If any other cargo from enemy ships he brought forward to Hongkong it will be liable to seizure and, if enemy property, to condemnation in whole or part, and the parties concerned in bringing it forward will be liable to prosecution miler the Trading with the Enemy Ordinance, 19911,
Any liquidators who have already taken part in bringing forward, or have taken delivery of, any such cargo as is referred to in the preceding paragraph must fornish all particulars of such cargo to the Crown Solicitor forthwith, if they have not already done so.
It must also be clearly understood (a) that the fact that cargo is consigned to a British firm or person does not necessarily make the cargo British property, and (b) that cargo which belongs to the enemy firms which are being wound up under the Alien Enemies (Winding up) Ordinance, 1914, is almost certainly in every case of enemy character, at least in part, as in probably every case part at least of the property. in the goods is vested in persons in enemy territory or in China.
The proper course with regard to all cargo sought to be brought forward from enemy ships is to apply beforehand for specific licences to bring forward the particular cargo in question. Such application should be made to the Attorney General.

In continuation of my letters of the 30th October, 7th November, 24th November, and 7th December, 1914, and the 1st February, 28th April, 4th June and 3rd and 18th September, 1915, I am directed to convey to you the following further instrue- tions of His Excellency the Governor :----
foods wider contract of sale to Chinese Dealers at Cantou. Canton cargo held here by the liquidators or hereafter to arrive must not be delivered to the Canton branches of the German firms on any terms, but goods under contract of sale to Chinese dealers at Canton may be delivered in Hongkong for cash to the dealers upon their producing contracts made before the 26th of June, 1915. The price to be paid should be the full contract price less duty.
This permission will not be available after the 30th November, 1915, for goods already in Hongkong, and steps should be taken to notify the Canton dealers of this time limit. One way of notifying them no doubt will be through the German firm at Canton, and letters will be franked for that purpose, but it would be advisable also to insert advertisements in some of the Canton newspapers.
In the case of goods not yet arrived, one month after arrival here will he allowed for the Canton dealers to take delivery. This should also be notified to the dealers through the German firm at Canton and by advertisement, and some arrangement should be made if possible for notiliying the dealers of the arrival of the cargo.
Now sales to buyers at Canton.
Fresh sales to buyers at Canton should be carefully scrutinised in order to prevent the German firius at Canton from indirectly buying from Hongkong. Any sale at what seems to be a low price would be open to suspicion, and no sale should be made to either British subjects or non-Chinese neutrals at Canton without reference to the Attorney General,

Report on an Ordinance intituled
An Ordinance to amend the Evidence Ordinance, 1889.
The main object of this Ordinance, which was intros
duced on account of the instructions of the Right Konour-
able the Secretary of State for the Colonies contained in
his circular despatch of the 26th May, 1915, is to assimi-
late the law of Hongkong to the law of the United Kingdom
in respect of the admissibility of affidavito and noterial
acts taken and made before British diplomatic or consular
officers. The only change effected by this part of the
Ordinance, i.e., by sections 2 and 3, is the enlargement
of the list of competent consular officers which was made
in the United Kingdom by the Commissioners for Oaths Act,
1891, 54 & 55 Vict. c. 50, 8.2.
An amendment of section 25 of the principal Ordinance
was thought necessary because it seemed doubtful whether
the definition of "consular officer" in the Interpretation
Ordinance, 1911, was quite wide enough,
Section 4 amends in three points section 32 of the
principal Ordinance,
Paragraphs (a) and (c) of that section correct a
grammatical mistake.
Paragraph (b) does away with what has often been a
source of embarrassment and might possibly have led in
some case to the loss of valuable evidence, 1.e.,
requirement that before a deposition can be taken some
medical practitioner must express an opinion that the
patient "is not likely to recover",
Paragraph (d) corrects a double error. In the first
place, the section as a whole relates only to indictable
offences, so that the clause introduced by the words, "if
the same relates to any indictable offence", exhausts the
whole class and leaves nothing to be operated upon by the
clause introduced by the words, "and in all other cases".
In the second place, the proper officer to receive the
deposition in cases where the accused has not been committ-
ed or belled to appear for trial is obviously the Kagis-
trate's Clerk and not the Registrar of the Supreme Court.
In my opinion this is an Ordinance to which His
Excellency the Governor may properly assent and in the
name of His Majesty and on His behalf.

The main object of this Ordinance, which was intro-
duced at the instance of the President of the Hongkong Law Society, is to enable a defendant to register a judgment without having to obtain the plaintiff's signature to the memorial. Inconvenience is sometimes oaused through the
unwillingness of an unsuccessful plaintiff to assist a successful defendant in this respect,
Sections 3 and 4 correct a more or less formal defect
in the principal Ordinance by providing for the case of a
judgment by which no "sum" is"recovered".
In my opinion this is an Ordinance to which His Excellency the Governor may properly assent and in the name of His Majesty and on His behalf,

telegram on 42502 should have referred to section 11 of the Trading with the Enemy Amendment Act 1914. The Governor also makes a mistaken reference in mentioning the Trading with the Enemy Ordinance 1914: he means the Trading with the Enemy Act. However, he has
understood our intention. I think his objection to
the employment of a Controller or Supervisor in such
a case is a good one. It had not appeared from pre- vious papers that the business of these companies was
carried on and managed entirely outside Hong Kong, in other words that the companies are "China Companies
within the meaning of the draft Order in Council now
before the Law Officers. As to the remedies which he
proposes, I do not think they are sufficient. Section

seem to follow as a matter of course that we shall
be able to terminate the companies' existence under
section 36. As to section 257, the Governor only
says that opportunities of enforcing it may arise. Moreover if these companies are, as stated above, "Chine

Grdinance 1911 will not apply to them when the new Companies Bill (see on 40876) is passed. If therefore it is necessary to take any definite action about
these companies, we must find some other way of doing it. You will remember that the position of companies
operating in China under British registration, but com- posed of enemy elements, was much discussed prior to the Interdepartmental Conference which took place at the beginning of August (see especially 28314 below).

but I have not been able to secure the paper in question. At any rate, the decision,which was, I think, confirmed by the Conference, was that no further action with regard to companies of this kind was required, having regard to the passing of the China, Siam &c. Proclamation and the prospective passing of the China Companies Order in
Council. The Order in Council and Proclamation will,
of course, make a considerable difference in the position
the buil of companies like the two now in question. Then it is passed, jurisdiction over them will apparently be vested entirely in the Supreme Court for China and any legi s- lation to enable them to be dissolved should presumably be passed for China and not in Hong Kong. Moreover, section 8 (1) of the draft Order in Council (see on
26700) provides that the majority of the Directors of
a China company shall be British subjects resident within the limits of the Order, and this provision should be of material assistance in enabling such companies to be
controlled. It seems to me therefore that it is not
very likely that Hong Kong legislation will be necessary or desirable, and in this connection I may call attention,
to 33838, which appears to have got mislaid after my
however minute of the 28th July. It is probable sess
the substance of it was considered at the Departmental Conference. You will observe that paragraph 5 of the
despatch refers expressly to these two companies. A9 to the question whether, if legislation is necessary, there is any objection on the ground of policy to passing it, it is of course true that we have never legis-
lated here with a view to making British companies
constituted of enemy elements enemies in law. I think
however that the two companies now in question stand
upon a different footing. The Proclamation of the Kli Sept makes plain, what was presumably already
law, that a Company carrying on business in enemy territory must, in so far as it does so carry on business be treated as an enemy. With reference to your telegram of the 20th September I presume that you refer to the Trading with the Enemy Ordinance 1914. There is no legislation here exactly corresponding to section 11 of that act but, see
Amendment) section 7 of the Trading with the Enemy Ordinance 1915. The objection to using that section is that the Companies will not slow the supervisor to carry out his functions.
It also seems doubtful whether a supervisor could be legally appointed of business carried on and mensred entirely outside of the jurisdiction even if it be carried on by a Company registered within the jurisdiction. The local regiater licences of these Companies under section 35 of the Companies Ordinance 1911 would not be renewed after the 31st of December and it then might be possible
to strike them off under section 36. Opportunities of
enforcing section 257 may arise. If immediate action is desired in my opinion the only effective step would be to take summery power to strike the Companies off the register on ground that preponderating number of apparent
enemy shareholders in the last annual summary.

With reference to the letter
from this Department of the 27th September
I am directed by Mr. Secretary Bonar Law
to request you to lay before Secretary
Sir E. Grey the accompanying copy of
telegraphic correspondence with the
Governor of Hong Kong on the subject of
the registration as British of certain
companies composed of aliens.
I am also to enclose a copy
of a despatch from the Governor dated the
18th June, of which paragraph 5 deals
with the Central and North China Godown
and Press Packing Company, and the
Yangtse Wharf and Godown Company, which
are the companies in question.
I am to explain that Mr. Bonar Law's
telegram of the 20th September should have
referred to section 11 of the Trading with
the Enemy Amendment Act 1914; and that the

1914 instead of the Trading with the Enemy Act.

policy involved, I am to observe that
although legislation has not been passed
in this country with a view to making
(British Companies constituted of enemy
elements enemies in law, these 2 com-

must, in so far as it does so carry

In continuation of my Despatch lo. 308 of the 14th. September, I have the honour to report that I have with the advice of the Executive Council banished from the Colony for a period of five years a man named Wong Fuk, bom in this Colony of parents neither of whom was a Britisa subject. Wong Fuk has not obtained a certifice of his British birth and he is not register- -ed at a British Consulate in China as a person entitled to Britisk protection in China.
This man is an habitual criminal, having been ten times convicted of various offences.

The following telegram has been received from
the Secretary of State for the Colonies and is hero
with repeated:-
With reference to my telegram of 28th August,
relating to Trading with the enery in China, etc. it
has been decided that a White List should be drawn up
of all firms whether British, Allied or Neutral who
usually import goods from the United Kingdom into China and Siam and are above suspicion and that ship-
ment of goods to any firm in the countries named which is not on the White List should be prohibited. The
object of this is to carry out the Proclamation of June 25th and to prevent enemy fims in Chine and
Siam continuing to trade under an alias whether
neutral or otherwise.
Accordingly a Proclamation has been issued under the Customs (Exportation Restriction) Acts September 24th which prohibits the exportation of all articles to China and Siam unless they are consigned to such persons or bodies of persons as may from time to time be notified by order of the Secretary of State for Foreign Affairs or of the Board of Trade to be published in the London, Edinburgh and Dublin Gazettes. Persons and bodies of persons so notified will con-
stitute a White List for China and Siam respectively.
If any person desires to export to any firm not included in the White List or if any firm not includ-
ed in the list desires to be placed on the list the
application will be referred to the Consular Officer
of the port concerned.

4. As it is considered possible that enemy
firms in China and Siam may try to carry on trade
through firms in Japan and the Dutch East Indies, a Black List is being prepared for these countries and exports to firms named in that list will be prevented
by the Customs War Powers Acts.
5. With regard to exports from the countries
named, imports into the United Kingdom made by the firms named on the China, Sim, persia, Morocco, Japan, Dutch East Indies Black Lists will be stopped by the Customs. The White List system will not be
applied in this case.
6. The British Ministers at Peking and Bangkok
will communicate to you the contents of the White Liste when they are settled. Additions to the White
List will be communicated to you by the British Consul at the Chinese and Siamese ports concerned. China, Siam, Persia, Morocco Black Lists

Hannibal has been informed by the Conference
Steamship Lines that in future they are unable to carry cargo
for him. A telegram received by the P. and 0. Steamship Co. from Mortlemen, London Secretary of the Conference Committee on
the 25th September in reply to a private letter from Hewett

The British Government is of opinion that with the exception of Arnhold you should not trade with the shippers
Aat accord- referred to nor should trade with Hannibal. ingly, Arnhold has been officially recognised as British, Hannibal has been recognised here as British firm. I am satisfied that he has severed all connections with
Wendt & Co. and he has lately taken a British partner. The only objection I have is that his agent in Canton is Huygen who is a Dutchman and is also representing Wendt & Co. at
Canton. But he is taking steps to replace him as soon as
possible by a British agent.
I therefore trust that the Conference Lines may be
authorised by H„M's Government to ship cargo for Hannibal.
