With reference to paragraph 3 of your despatch No.
133 of the 29th of May, I have the honour to enclose a copy of the usual form of Crown Lease, which is for 75 years renewable with building covenant. There has been no variation in the form of Crown Lease of building lots for 75 years with the exception of the clause granting a renewed term of 75 years, which was introduced about 15 years ago.
In only two cases have leases for 99 years been granted and in those cases the form of the Crow Lease was the same as the 75 year renewable leases with the exception of the renewable clause. From the date of the instructions of the Secretary of State that 999 years should be no longer granted up to the date when he approved of 75 year renewable leases, that is from the 20th June, 1898, to the 31st July, 1899, all leases were for 75 years only.
With regard to paragraph 2 of your despatch I would point out that, with the exception of a comparatively small number
of farm or garden lot leases, all the leases in Hongkong are build-
ing leasee, and if you should decide that in the case of such leases the building, if the site is required for public purposes, should vest in the Crown at the expiration of the lease without any compensation to the lessee, there will be no necessity for the notification of which a draft was enclosed in my despatch No.117

Should you, however, decide that compensation should
be given then I am of opinion it would be preferable to give it,
in the circumstances indicated in the enclosures to my despatch

With reference to the cypher telegrams noted in the
margin, paraphrases of which are enclosed for
convenience of reference, I have the honour to
transmit for your consideration and favour of
instructions by telegraph thereon, the enclosed
copy of correspondence with His Excellency the General Officer Commanding, South China, on the subject of the
treatment as prisoners of war of those enemy subjects, allowed to
remain in the Colony under parole, who have now become liable to
Military service in consequence of the calling out of the various
classes of the Landeturm. I enclose also copy of a letter address-
ed to me by the Commodore on the same subject.

On receipt of Major-General Kelly's letter of the 1st
instant I discussed it with him orally and expressed the opinion
that inasmuch as all the 74 persons concerned had been under parole
for a considerable time and had conducted themselves well and
as the large majority of them were well known residents connected
with business firms licensed to trade in the Colony, I considered
that they were covered by your telegram of the 9th of August. I deprecated telegraphing to you on the subject as the facts could not be laid before you within the compass of a telegram, and it was agreed that I should refer the question to you in a despatch and ask
for a telegraphic reply.

information received from His Britannic Majesty's Consul-Ceneral
at Canton, called out on the 8th of September. The call did not
affect Germans in this Colony since they cannot leave it without
my permission. But the call technically has rendered most of the 74 persons named in the list liable to serve. I may mention here that about 90 first reservists left the Colony shortly before,
the outbreak of war for Tsingtau.
In justice to the German Consul I should also
explain here that when he furnished the list of German subjects who
were paroled on the 7th and 8th of August, he intimated that as he
had no census of German residents there might be others not includ-
ed in his list. The Police were accordingly instructed to make a
complete census of all Germans and Austrians in the Colony and the compilation of the list occupied some time. This may partly explain the discrepancy in the figures of those ultimately liable
for service, and accounts for the late date at which some of the
residents were paroled. Mr. Rosemann only returned to the Colony
recently.
An examination of the list of names which accom-
panied Major-General Kelly's letter of the 5th instant shows that of the 74 persons named therein 48 are members of the German Club in this Colony. Among these members are comprised Mr.Gutecke and Mr. Hock, the lianager and Assistant Manager of the Deutschą- Asiatische Bank and many other well known business men who are either in charge of, or assistants in, German firms licensed to trade here. In this connection I may mention that on the departure of the German Consul Mr. A. Becker, Chairman of the German Club, and Mr. 0. Struckmeyer of the firm of Siemssen & Co., asked me on behalf of the Committee of the Club to report to them if there should be any complaint of misconduct on the part of any resident member of the Club in order to enable the expulsion from the Club of any member who should infringe his parole or otherwise
misconduct himself. The remaining 26 persons are employed in
various capacities in the Colony. The only one amongst who is
marked as of suspicious character is Mr. Kunze. I recently made
enquiry concerning this person and I attach a copy of the report
which I received from the Captain Superintendent of Police on the
subject. I did not consider that this report justified his deport-
Concerning the conduct of the persons named in the
list, I attach notes of a conversation I had with the Provost
Marshal whom the General Officer Commanding sent to me to explain
certain items in the column of complaints in the list. I would also point out that not one of those named in the list has, as far
as is known, committed any breach of his parole. A complaint was
made to me by the General Officer Commanding in August of noises at the German Club at night, but enquiry by the Police showed that residents in the neighbourhood had no complaints on the subject. Enquiry has again been made as to the rowdiness at night and the spreading of rumours and inciting of Indians and Chinese against the British Government mentioned in Major-General Kelly's letter of the 5th instant. I attach a copy of the report of the Captain Superintendent of Police. I may say that as far as I know there is not a German in the Colony who can speak any Indian language.
It is scarcely correct to say that Germans and Austrians are allowed to move about freely at all hours. Their movements are restricted to certain areas agreed upon between the General Officer Commanding and me. They are not required to be within doors at a certain hour of the night because such restrict- ion has not been asked for by the Military Authorities, nor does
it seem necessary.
In the matter of the trade which German residents are permitted to carry on, that is a matter which does not seem relevant to the question at issue. It is a question that has been
already settled by His Majesty's Government.
That the presence of a number of Germans and Austrians does render greater precautions necessary is true. I
can only say that the Colonial Government have rendered and will
render in the future every assistance in making those precautions
effective if you decide that present arrangements are to continue.
Finally I would remark that if at any time before
the close of the war it is desired for whatever reason to arrest
as prisoners of war any or all of the persons referred to in this
despatch, such arrest can be carried out as none of the 74
persons will be allowed to leave the Colony.

General Officer Commanding and to the Commodore.

It has now been decided by His Majesty's Go-
vernment that it is most important that all enemy's
reservists should be detained as prisoners of war, whether
naval or military, in order to enforce proper treatment of
British Officers and men who may be captured. You should
therefore act accordingly. Direct Reporting Officers to
telegraph direct to Admiralty names of merchant vessels
whether British or neutral, on which enemy's reservists
have embarked.

Instructions of your telegram of August 7th noted.
German merchants and their employees to the number of about 100
and equal number of wives and children are, however, in the
Colony. About 20, including the German Consul, are 2nd reser-
vista not called up owing to nature of employment and age, the
rest are exempt from military service. Subject always to with-
drawal of indulgence at any time, I have permitted all these,
with the concurrence of the General Officer Commanding, to remain
on parole and subject to restriction of movement in the Colony
and undertaking not to leave it.
British subjects have been similarly permitted to
remain at Esingtau on parole.
The only Austrian here is the Consul, as far as I know.
I do not know if he is reservist, and I have not as yet put him

Austrian residents in this Colony, 20 were 2nd Reservists and

On the understanding that few of them
were liable for service and that the arrangement was a temporary
one which could be altered at any time, I concurred with the recommendations made by Your Excellency in your cable of the 8th August to the Secretary of State for the Colonies.
Owing now, however, to the number of these
residenta that have become liable for service (74 out of 127 ) and to the general behaviour of Germany in her dealings with her enemies, I submit that the time has come to reconsider the decision. It is true that with the exception of some rowdiness at night owing to their being allowed to move about freely at all hours I cannot say that they have behaved badly on the whole. Still, I look upon every German (there are practically no Austrians) men or women, at large in this Colony, as a potential factor for evil, and possibly for prolonging the war.

firms to get hold of. Their presence renders it necessary to
take more elaborate precautions in guarding all important places.
Taking all this into consideration I beg that this
letter may be laid before His Majesty's Government with a view

Hon. Colonial Secretary,
Mr. Kunze is employed at Messrs. Shewan, Tomas & Co. Married. Has been in Shewan, Tomas & Co. about 7 years. Formerly employed by a German firm in Canton. About a year ago the Austrian Consul-General told me personally that he had intimate knowledge re certain pepers stolen from the Austrian Consulate.
It was reported that at the outbreak of war he had been heard to
brag of his knowledge of the defence of the Colony. He was rude
to some English ladies at Weismann's, and has talked at Kowloon
of what Germany could do. He has been on the "to be watched" list
since the beginning of the war.

Major Lawler, Provost Marshal, attended at the Colonial Secretary'e
Office at 10.45 a.m. on Thursday 8th October, 1914, and gave
certain information to His Excellency the Governor with regard to
German and Austrian subjects in Hongkong liable for service.
Major Lavder. As regards No.38 Haasmann, No.116 Kunze and No.119 Siedel, the disturbance referred to at the Café Weismann is the incident, referred to some weeks ago in the Public Press, of throwing down and stamping on a copy of the "China Mail" which contained the news that the English Government had compulsorily
purchased two battleships building for Turkey.
As regards No.16 Gutschke, No.18 Haeslop and No.63 Koch. Have received report from Mr. Liébert, the Consul- General for France, that these men at a dinner party before an English Lady spread news of the sinking of the vessels "Paul Lecat" and "Nile", but the evidence is not complete yet and would ask
for action to be suspended.
As regards No.70 Lehmann, Dr.Lindsay Woods and Colonel Moberly reported that he and others sang German songs and shouted "Hoch" at night at his house in Kowloon.
As regards No.182 Lorria. He is an Austrian Officer, who tried to frighten Chinese by spreading reports that aeroplanes were coming from Tsintat to drop bombs in Hongkong. Ne He is a man who is liable for service up to 60 years of age.
As regards Reichmann, the Manager of the Grand Hotel, He is a special case as he has always wished to be naturalised as a British subject. He has behaved very well since the war started. He has always communicated any information to the Military Authorities and has conducted his hotel and bar in an

I attach report from the Chief Detective Inspector with copy of refused charge and statement by sergeant in charge at Central re incident of two Cermans and a Dane being met by Police
Constable A33 Reid coming from a brothel in Old Bailey at about
1.30 in the morning. There was really nothing in this.
2. Police Sergeant 61, Adlington states that on the night
of the 30th ultimo at 10.15 p.m. he met Lance-Sergeant Cockle
opposite No.2 College Gardens. There appeared to be a great
jubilation going on by what appeared to be about 10 persons. The
noise was a nuisance and I called the boy and told him to tell his
mater to tell his guests to make less noise. The master shortly afterwards came out of the front door and I spoke to him person-
ally and asked him to stop the noise or I should have to report
the matter. The noise then stopped and I went away. The master
of the house was a German and I do not know his name. He was a
tall man. This was the night of the last publication of the S.M.S
"Enden's capture of British boats.
3. Rev. Machonachie of Union Church who lives close to the
German Club states that the Germans are behaving more quietly and
orderly than ever at the German Club. He remembers that on the night following the first news of the Enden's capturing British ships they appeared to have a jubilation, but he had no cause for
complaint. His only complaint is of the noise in the bowling alley which on some nights appears to go on all night. The noise is made by the balls rolling and knocking the pegs.
Above is the only evidence I have had regarding noise
and rowdiness.
I have been unable to get any evidence of their spread- ing rumours and inciting Indians and Chinese in this Colony against the United Kingdom.

With the exception of the incident in the attached extract from refused charges book, as far as I can ascertain, the Police neither in Hongkong or Kowloon have had any occasion to complain of the behaviour of Germans or Austrians, since the outbreak of war.
It was once rumoured in the early stages of the that the inhabitants of the German Club were behaving in
a noisy and boisterous manner there, but both Police in uniform
and Police in plain clothing keeping close observation on the
place, failed to see or hear anything out of place.
The Police interviewed several of the inhabit-
ants in the vicinity of the club and they stated that as
regards the noises complained of at the Club before the out-
break of war, all had been tranquillity since.

In continuation of my secret despatch of the 25th September, I have the honour to transmit the enclosed paraphrases
т and translations of cypher and code telegrams' received from you and despatched by me to you on the subject of the Anglo-German War. The information and instructions contained in your telegrams have been communicated to those concerned. I make the following references to special cases.
Your telegram of the 23rd September, which contained an outline of the proceedings conducted by His Majesty's Prize Court in London in the case of a detained vessel has been communic- ated to Prize Court Authorities. At the investigation of the S.S. "Rajaburi", the only vessel detained in this port, a similar proce- dure will be adopted.
The instructions contained in your telegram of the 23rd ultimo are being complied with. I will, however, report upon the action taken in a separate despatch and forward the returns required.
On the 25th September "I telegraphed the names of all prize ships which have been brought into this port by His Majesty's war ships. One vessel you will observe was a joint Anglo-French capture. I may add, with reference to your code telegram of the 24th September "regarding ships whose cargo has been detained, that
no case of the kind has arisen to date.

I regret the serious and unforeseen delay which my secret despatch of the 12th August suffered in transmission and regarding which the telegraphic correspondence concluding with your telegram of the 5th October has arisen. I may explain that after the outbreak of hostilities, the Siberian service was suspended, also the service via Canada, and the P.& 0. Co's service vià Suez was threatened with interruption owing to the possible activity of hostile cruisers. I took advantage of the American mail service vià San Francisco and New York, which, though not expeditious, offered greater security. I presume that the delay was accentuated by the dislocation of the steamer services from New York to Europe.
I enclose for your information a table giving dates
and particulars of despatch of the periodical secret despatches on the war and of other important confidential despatches on the same subject which I have addressed to you since the outbreak of hostilities.
I am addressing you in a separate despatch regard- ing the telegraphic correspondence on the subject of trading with the enemy ending with your code telegram of the 3rd October.
With reference to paragraph 15 of my secret despatch of the 12th August the Committee appointed to control the price of foodstuffs appear to have attained satisfactory success. Weekly meetings are held under the chairmanship of the Colonial Treasurer, when the maximum sale prices of all important foodstuffs are fixed and notified in the Government Gazette. The principal considerations taken into account in fixing prices are the fall in exchange, increased insurance on freights, and increased cost of labour. It is satisfactory to note that it has been necessary to prosecute in only two instances.
