In reply to your Despatch lo. 313 of the 15th.
of October, I have the honour to inform you that your interpretation of the meaning of Clause C of the draft terms upon which I recommend -ed that this Government should deal with the question of the renew- -al of Seventy-five years Crown Leases, is correct. I regret that my Despatch No. 271 of the 28th. of July was not more clearly worded.
I have also to inform you that I am satisfied that it is not possible to differentiate between Crown Leases in the Hill District and similar Crown Leases elsewhere in the Colony.
I am not sure, however, how you wish renewable leases to be dealt with, and I notice that you make no reference to 99 years leases to which I referred in the last paragraph of my Despatch quoted above.
I have assumed that you desire to apply the principle of compensation for improvements to 99 years Leases; and it seems to me that if that is so it is reasonable, and unobjection- -able, to treat 75 years renewable Leases in the same way as 75 and 99 years Leases. The only alternative would be to issue a notice that Lessees holding renewable Leases would be given some compensa- -tion at the expiration of the renewed term. I am of opinion that it would be impolitic to give any such undertaking, for in the event of a severe depreciation in land values this Government might

find itself saddled with a heavier liability than it could meet. Moreover such a vague promise would be of little value to Lessees.
It is necessary to exclude the New Territories from any Notification that may be made, because the Leases there are for the most part for 75 years renewable for 24 years less 3 days; and the method of dealing with Leases of Crown Land for Charitable, Religious or Scholastic purposes has to be considered.
I propose that these Leases shall be excluded also. The Government obtains practically no rent from such Leases, and the class of building which is to be found on land leased for these purposes is of a kind that is useless for ordinary purposes. It might be possible, if you think it desirable, to formulate a modified scheme for dealing with compensation for such buildings, but on the whole I and my advisers have come to the conclusion that these Leases should be excluded.
In view of the remarks made in the preceding paragraphs, I have now to submit for your consideration the drafts of two Notifications dealing with the matters referred to. The draft marked 'A' follows closely the scheme originally proposed by me and approved by you. The draft marked 'B' differs from 'A' in that it throws upon Lessees the onus of obtaining information as to renewal of their leases. It was pointed out to me by the Land Officer that the obligation cast upon the Government by making the Colonial Secretary responsible for notifying Lessees whether or not the Crown will re-enter into possession of the 1 and and buildings, is a very heavy one; and that in the event of delay, through mistake or inadvertence, in giving the notice the Govern- -ment might be mulcted in heavy damages. I have therefore had the Notification re-cast in the shape of draft 'B' which I recommend
for your consideration.

Not less than 18 months prior to the expiration of any lease now in existence of any land held from the Crown either for the term of 99 years or 75 years or in the case where a lease has been granted for a term of 75 years with the option of renewal for a further term of 75 years then not less than 10 months prior to the expiration of the second term of 75 years where the Lessee has exercised ais option of renewal the Colonial Secretary will notify the Lesses whether the Crow will re-enter into possession of the Land and the building thereon or not.
(b). If it shall be considered desirable on the part of the Crow to
re-enter on such land the Colonial Pecretary will at the same time inform the lessee that compensation for the buildings and improve- -ments will be paid for at a valuation to be fairly and impartial- -ly made by the Surveyor of His Majesty His Heirs Successors or Assigns.
(c). If it shall be considered desirable to grant to the Lessee another
lease of such land the Colonial Secretary will at the some time forward to the lesses a statement of the premium and of the Crown Rent in consideration for which the Crown will renew the lease for
one further period of 75 years,
(d). If the Lessee shall refuse to accept renewal on the terms referred
to in clause (c) hereof compensation as in clause (b) hereof shall
only be payable if the Crow effects a new lease with a third
party within lo months of the expiration of the lease.
(*). In the event of any such land being divided into sections and sub-
-sections, such sections and sub-sections shall be regarded as

(a). The Lessee of any land which at the date of this notification

With reference to the telegraphic correspond-
-ence noted in the margin, I have the honour to inform you that on the 31st. ultimo I telegraphed to the Governor-
-General of the Dominion of Canada enquiring whether these Indian emigrants who were not travelling on through tickets from India would be allowed to land in Canada.
On the 2nd. instant I telegraphed again asking
for an immediate reply and on the 6th. instant I telegraphed that I had been unable to detain the vessel any longer and that she had sailed for Vancouver on the 4th. instant.
The vessel was to have sailed on the 28th. ultimo and she was purposely delayed by my directions by delaying her survey for a Passenger Certificate and subsequently by my refusing to sign that certificate. I was advised, however, that I had no legal authority to refuse a Passenger Certificate under Ordinance 1 of 1889 or a clearance under the Merchant Shipping Ordinance. I was also advised that the Emigration Ordinance as it stands does not apply to Indians. I may mention here that the new Emigration Bill which has been sent to you ap lies to all Asiatics and that the discretion in the Governor to grant an Emigration Licence is absolute.

In the meantime the Police went on board the
vessel and warned the passengers of the terms of Government Notification No. 249 of 1908, copy enclosed. The charterer was also informed of the terms of that Notification, and to his Solicitors was addressed a letter under date of the 4th. instant, copy enclosed, intimating that the granting of the Passenger Certificate did not mean that the Indian passengers would be allowed to land.
On the 8th. instant I received the telegram copy enclosed, from Ottawa the contents of which has been com- -municated to those concerned in the despatch of the vessel.
It appears that a Sikh of the name of Gurdit Singh came here about the middle of larch and acting on behalf of a Company or Syndicate called Sri Guru Nanak Steamer Company chartered the "Komogata Maru" for 266,000 for 6 months in order to convey Indians to British Columbia. I enclose translation of a notice issued by Gurdit Singh here and also copy of notes of a conversation which the Colonial Secretary, to whom Gurdit Singh was known formerly in the Federated kalay States, had with that person.
The majority of the Indians who left in the steamer are reported to have come here during the last 2 years with the object of going to the United States of America. They failed in accomplishing that object and have been maintaining themselves here as watchmen and in other civil employment. They are said to be illiterate and of the agricultural class. It is apparently the intention of the charterer to pick up other Indians at Shanghai and Japan.

This happy news will be read out with a great plea- -sure and love amongst the Indians specially the Khalsa Panih, that by the great mercy of Sri Guru Nanak Dev and Guru Gobind Singh Ji, the Sri Guru Nanak Steamship Company is firmly fixed and the first steamer "Komagatu Maru" on hire strats for Vancouver Canada on the 28th. March. I give congratulations and honour to the whole India fe for this important business.
All the men know this that there are many rich people living in our country especially in Punjab, but no one dared to carry out the foreign commerce. By the great mercy and blessings of Guru Sahib and with his helping hand upon me, I being helpless like an insect, am encouraged to undertake this important business.
Why did I think it essential to do this ? The rea- -w¤ is this, that when I came in Hongkong for some private business in January, 1914, I could not bear the grief and hardship of the Vancouver emigrants who had been waiting in the Sikh Temple of Hongkong. It was a matter of injustice and darkness, I thought, because our brethêyn were passing their days in a miserable state for the hope of arriving at Vancouver while staying here for one year and spending money for their eating from their own pockets.
This was the object that wounded my heart. I could not bear this and I thought that anyhow these miserablepeople may succeed to go to Vancouver. Therefore I left my promise withthe passengers upon my leaving for Singapore, that they must write to me if the Companies refuse to sell them the tickets, then I will try my best. I will fight out this case in the Supreme Court at Canada for the decision in our favour for ever. If the Canadian Government will persist, then I will ask the necessary questions from my British Government. I will not return back until the real

For this reason a steamer is chartered for the term of 6 months on the 24th. March because when we have our om steamer, she can remain there and necessary arrangement can be made for the landing of the passengers. We will also consider the resolutions for the improvement of Commerce.
Upon this 1st. trip, there is a hope of getting about 300 passengers up to Shanghai. Upon the 2nd. trip the steamer will start from Calcutta.

This steamer by name of "Komagata Maru" belongs to a Japanese Company, and it was arranged to get this steamer through Mr. A. Bune, a well known agent. If any one wants to ask some more, he may do so from the above address in Hongkong.
The steamer is chartered for $66,000 for 6 months and her expenses are all to be paid by me.
It is now clearly believed that Sri Guru Nanak Steamship Company's steamers will go around the whole world in future. It is hoped that the company will be registered upon our arrival at Vancouver.
At the present, only I got the responsibility of this business, no one else dared to buy any share. I hope many men will buy shares after seeing the improvement in this business,

Gurdit Singh, who has arranged for the transport of a
number of Sikhs by the S. 8. "Komogata Maru" to Vancouver, came to see me at the office on Saturday the 4th. of April. I found that he was a man whom I had known in Selangor in 1899 and 1900. He was then living at Serendah and was reputed to be well off. He appeared frequently in the Law Courts in Civil cases and had a great hold over the local Sikh community.
The reason for his visit was merely on account of his previous acquaintance and he did not wish to refer to the difficulti -en which had arisen in connection with the departure of the snip. I took the opportunity, however, of getting some information from him as to his intentions. He asked to be allowed to speak in the Malay language. He said that he had made a good deal of money out of Railway Contracts in the Federated Halay States and by planting rubber. That in arranging for the emigration of the Sikhs to British Columbia he was actuated solely by a desire to assist his fellow countrymen and co-religionists, and that if they were refused entrance to Canada it was his intention to fight the case in the Courts. That in the meantime he might arrange for the ship to return to Calcutta and return from there to Vancouver.
He assured me that he had no political motives in acting as he did. He said that there were already about 5,000 Sikhs in British Columbia and that the climate suited them. He was careful to choose only men who would be suitable such as those of the farming class. He hoped to have four steamers regularly engaged in the emigration business between Calcutta and Vancouver and that it was his intention to arrange for about 25,000 men to go to British Columbia.

In reply to your telegram of April 8th in cypher I regret that I am unable to modify my
opinion because the situation in Kwang Tung has become worse since the date of my despatch January 22nd.
Troops are supposed to be paid ten Mexican dollars a month; but, owing to depreciated currency they receive less than six dollars. I would point out that it was necessary last year to detach 400 Infantry to protect Shamien and that in addition four guns and a battalion of infantry were held in readiness to protect the Chinese section of the Canton Kowloon Railway. Even larger numbers than those would be required if disturbances took anti-foreign turn.

by Mr. Ede, were formulated in accordance with the terms on which Mr. Ede agreed with Sir F. D. Lugard to take up the land for a Portuguese Settlement, Mr. Ede or his Solicitors, to whom in his absence the conditions were sent, found that the condition which provided for reversion to the Government of the land or any
portion thereof in the event of its being relinquished owing to failure of the scheme, did not provide adequate security on which to raise the money required for financing the scheme. This difficulty made it necessary to recast the conditions to make them approximate to the usual conditions in a sale of land to which the purchaser wishes to obtain a marketable title. Owing to Mr. Ede's absence from the Colony for some months in 1912 and a further absence owing to illness last year I have only recently been able to arrange terms which were acceptable to him.

(a). The premium which was originally 8500 an acre is
now fixed at 2 cents a Square Foot. (Condition B). The premium is thus increased from 822,500 to 840,000 in round figures.
(b). In place of the road to be made by the Government
at a cost of $55,000, the Government will extend
a smaller road in course of construction to the Reserved Area. (Condition G).
The cost of this road is estimated at about 10,000. (c). The lessees will have to pay for all sewers and
storm-water drains required outside the boundaries of the Reserved Area for connecting with the City Sewerage System or any existing nullah or stream course. (Latter part of Condition H). (d). Condition K which has been omitted referred to
nullahs in the Wong-nei-chong and Sookumpoo Valleys to be constructed at Government expense up to a limit of cost of $88,000. I consider it unnecessary to refer to drainage works to be carried out by Government outside the Reserved Area, for these have nothing to do with the scheme. But the Govern- -ment will in this case, as in any other alienation of land, take such measures as may be necessary to receive the drainage from the area.
(e). Condition N which has been omitted referred to a
Market to be constructed at Government expense, but this was considered unnecessary.
(f). Important new clauses have been inserted lettered
R, R, S, T, U, and z2. These are designed to guard against the land, which is granted on easy terms for the philanthropic purpose of a Portuguese Settlement, being diverted to other, and more lucrative uses; while leaving a loophole for admitting persons of other race to the enjoyment of the area in the event of the primary object of its
its development failing of success. Clause R1 is designed to provide for a Provident Purchase Scheme which the Promoter is anxious to establish.
Mr. Ede has accepted the scheme, and I enclose copies of correspondence with him, which resulted in the settle- -ment now arrived at. I understand that Mr. Ede sent a copy of his letter of the 19th. November to you so that it is unnecessary for
me to trouble you with matters which have now been satisfactorily settled. You will observe that in a postscript to the letter of the 28th. February I caused Mr. Ede to be informed of your decision as regards compensation for tenants improvements at the expiration of leases.
I trust that you will be able to approve of the scheme as revised. It is more favourable to the tax-payers of this Colony than the original scheme, which in view of the condition which proved unacceptable was sketched on more generous lines.
I have no objection to the usual rule of sale by auction being relaxed in this case. But I would suggest that it is waived the conditions under which the land is to be alienated should be laid before the Legislative Council before any Lease of the area is definitely promised to Mr. Ede.

"THE PORTUGUESE RESERVATION AREA".

(A). The area of Crow Land to be taken up shall be about 45 acres
(more or less) situate approximately in the position shown in red on the plan hereunto annexed and such area shall be known as the "Portuguese Reservation Area" or by such other designation as may be approved by the Government. (In these conditions hereinafter referred to as "THE RESERVED AREA").
(B). Premium at the rate of two cents per square foot shall be paid
into the Colonial Treasury within 7 days of the date of a notifica- -tion in writing signed by the Director of Public Works of the amount payable.
(C). Crown Rent at the rate of 100 per acre par anum shall be payable
as from the date of the notification referred to in Condition B above. For the purpose of determining the area in respect of which premium and Crown Rent shall be paid in the first instance, the exact amounts payable will be determined as development proceeds.
On completion of the laying out the amount of premium payable shall be adjusted in accordance with the actual areas of the lota when any further amount found to be due to the Government shall be paid by the Lessees or any excess amount already paid by the Lessees shall be refunded to them by the Government, but no interest shall be paid in either of such cases.
The mount of Crown Rant to be paid shall be adjusted from time to time as development proceeds.
No arrears shall be charged in respect of any additional Crow Rent that may from time to time be found to be payable and similarly no refund shall be made in respect of any reduced Crown Rent that may from time to time be found to be payable. (D). The term of the lease of "The Reserved Area" to be granted to the Lessees shall be 75 years (renewable for a further term of 75 years at a re-assessed Crow Rent) and shall commence from the

Area the road at present in course of construction to Inland Lota 1946 and 1947 in order to give access to the Reserved Area. (H). All sewers and storm-water drains within "THE RESERVED AREA"
except as hereinafter mentioned shall be constructed and maintain- -ed by the Lessess at the Lessee's om expense and to the satis- -faction of the Director of Public Works. All sewers and storm- -water drains situated in the area laid out as rouds and lanea shall be constructed by the Government and maintained by the Government at Government expense.
All sewers or storm-water drains required outside the boundaries of "THE RESERVED AREA' for comecting the above mentioned sewers and storm-water drains with the City Sewerage System or with any existing mullah or stream course shall be constructed by the Government at the expense of the Lessees but shall be subsequently maintained by the Government at Government expense.

Government for the proper drainage of Crown Land adjoining "THE RESERVED AREA" but subject nevertheless to the proviso that when the sun expended by Government upon the construction of such nul- -lahs and channels shall have amounted to $38,000.00 the Government shall not be called upon to expend any further sun on such construction.

(L). The Lessees shall make such arrangements as the Lessees think fit
for lighting the roads and lanes within "THE RESERVED AREA" subject to the approval of the Director of Public Works.
(M). The Government shall be under no obligation to light the road
referred to in Condition G above.
(N). (Omitted).
(0). The Lessees shall erect and maintain at the Lossess expense a
church and a soho d, which shall be constructed in accordance with plans approved by Government.
(P). The Lessees shall lay out and maintain at the Lessees expense a
Recreation Ground in accordance with plans approved by Government. (Q). All arrangements for scavenging and policing "THE RESERVED AREA"
shall be carried out and controlled by the Government at Govern- -ment expense.
(R). No person other than of Portuguese Extraction except a domestic
servant employed by an authorised resident in "THE RESERVED AREA" or priests or school teachers employed in the Church or school situate within "TIE RESERVED AREA" or medical practitioner practis- -ing within the said area shall reside in that area, and no sub- -lease shall be granted by the Lessees to any other person than of Portuguese Extraction without the written permission of the

of "THE RESERVED AREA" except so far as may be necessary to raise money upon debentures for the purpose of floating the scheme to develop "THE RESERVED AREA" and except in so far as it may be necessary to charge any portion of "THE RESERVED AREA" to secure any sub-lessee participating in a Provident Purchase Scheme here- -inafter mentioned, without the consent of the Governor-in-Council: and every sub-lease of any portion of "THE RESERVED AREA" shall contain a clause prohibiting the sub-lessee from mortgaging or charging or transferring his interest in any portion in any manner whatsoever.
(R1). The sub-lessees shall have the privilege of participating in a
Provident Purchase Scheme to be organised and controlled by the Lessees of the Reserved Area whereby on payment of a monthly instalment extending over a period of not less than 25 years the sub-lessees shall become the omers of the portion of "THE RE- -SERVED AREA" and the buildings thereon comprised in their sub- -lease as Lessees of the Crown for the remainder of the term of 75 years of ani subject to the terms and conditions of the Crow Lease of the Reserved Area granted to the Lesseer.
($). In the event of the Lessees sub-leasing any portion of "THE
RESERVED AREA' such sub-lease (which sub-lease shall be in a form to be approved of by the Government) shall contain a condition prohibiting the sub-lesses from disposing of such portion at any enhancement in price other than such as is justified by expenditure which the sub-lessee may have incurred in making permanent im- -provements on such portion. In the event of any dispute arising as to what are such permanent improvements or as to the value of such permanent improvements in each case the matter shall be referred to the Director of Public Works whose decision shall be final and binding on all parties concerned.
(T). In the event of any sub-lessee desiring to dispose of his sub-
lease to any person other than of Portuguese Extraction he must first obtain the sanction in writing of the Lessees of "THE RESERVED AREA" and of the Governor-in-Council.

sub-lease shall revert to the Lessees of "THE RESERVED AREA" who may dispose of it in such manner as they shall consider fit and proper in the interests of the creditors of auch lessee.
(V). In the event of any profit remaining in the hands of the Lessees
of the Reserved Area after realisation of the interest of the Lessees of the Reserved Area in the Reserved Area and after de- -fraying all charges for maintenance, repairs, insurance and interest at the rate of 8% per annum on capital expenditure to date such profits shall be paid into the Colonial Treasury to the credit of the Government.
(W). The Lessees of "THE RESERVED AREA" or their sub-lessees shall
expend a sum of not less than $400,000 in erecting and completing fit for occupation within 48 months of the date of the notifica- -tion referred to in Condition B above one hundred houses. (I). All rates shall be paid in accordance with the terms of the Rating Ordinance, 1901, and any subsequent amending Ordinance on all properties within "THE RESERVED AREA".
(Y). Any buildings erected or works carried out within "THE RESERVED
AREA" shall be erected and carried out and maintained in accord- -ance wita the provisions of the Public Health and Buildings Ordinance and any amendment thereof and adequate insurance shall be effected by the Lessees in respect of all houses and buildings erected to the satisfaction of the Government.
(Z). The Government shall grant facilities for the construction of a
tramway connecting "THE RESERVED AREA" with the Electric Tramway Company's System, provided that no expense shall be thereby entailed upon the Government.
(22).The Lessees of the Reserved Area shall not be at liberty to dis- -pose of their interests in any portion of the Reserved Area except as mentioned in Conditions R and Rl above without the previous consent of the Governor-in-Council signified in writing and subject to such conditions as the Governor-in-Council, with the approval of the Secretary of State for the Colonies, may impose.

Having now returned to the Colony, I have the Honour to acknowledge the receipt of your letter of the 25th August last Io.1209/1912 the contents of which I need hardly say
are disarpointing and the terms now offered by the Government so entirely different from what were originally proposed that I venture to point out to you the many disadvantages and additional burdens now sought to be placed upon the intended Lessee of the land in question by the Government.
BALE OF LAND, In the first place you state that the land be put up to motion in the ordinary manner at a minimum price of Tro cents per square foot. This would inevitably lead to competition by land speculators to the great disadvantage of the Scheme and to the intereste of those whom it is designed to benefit. CROT REIT.
This you state is to be charged on the whole area, no rebate being made for such portion of the
land as is to be used for a Market.
ROADS AND LANES The Government do not now undertake
to maintain the roads and lanes after they have been
constructed.
PUBLIC ROAD,
The Government now asks that the Lesare
do contribute a sum of $8,000 towards the construction
of a road of a width of ten feet instead of a road of
a width of fifteen feet for which the Lorree was
originally asked to contribute the sum of $6,000. A
ten foot road is in my case too marrow for the purposes
of the "Reservation".

SEWERS AND DRAINS. The Government do not now undertake to
maintain the sewers and drains after they have been cone- tructed.
The Lessee is now asked to contribute
a sum of $20,000 towards the construction of a water
supply even though the Lessee will have to pay water rates in addition to the above expenditure.
NULLAHS.
The Government now withdraws its
offer to construct and maintain the mullahs in the
Fong naichong and Soo Kung Poo Valleys for the reception
of drainage of Crown land adjoining the area in respect
of which the Government offered to expand the same of $88,000 and considered that no economy on the expenditure proposed in this respect was possible.
The Government do not now undertake
to construct and maintain a market.
SCAVENGING.
The Government now withdraws its offer
to carry out scavenging on the area.
BUILDING STIPULATION. The Government now raquires that
the Leeree shall expend in buildings to be completed and
to begome rateable a sum of not less than $400,000 within
Thirty six months from the date of sale instead of within
Forty eight months as formerly required.
RETAINING WALLS.
Reference is for the first time now
made to these, the object of such reference at this late
date being obscure.
In my letter to you of the 7th July last and on Hig
Excellency's express suggestion, I arended my proposal and
offered the Goverment a premium of Two cante per square foot
(which was the full value placed on the land in question by the

would thereby be enabled to see its way to withdraw the restriction imposed by Condition ge which I explained was
necessary in order, in certain events, to assist the repay-
ment of the Debentures which it is essential to ficat in
order to finance the scheme.
After very careful consideration of your letter under
reply, I regret that I can come to no other conclusion than
that the Government is averse to the proposed Portuguese
Reservation Scheme; a scheme which I am convinced and which
convlotion is also shared by a great number of influential
British residents in the Colony is sadly needed in order to
provide suitable housing accommodation for the poor but
deserving Portuguese who form a section of the community
very necessary to the prosperity of the Colony and who are
admitted to be generally honest, industrious, trustworthy
and accurate in the discharge of their duties.
I have from the very first pointed out that the emoceas
of the Boheme is dependent upon Government assistance without
which the project is doomed to failure and at the commencement
of my negotiations with the Government I was glad to find that
His Excellency Sir Frederick Lugard took a sympathetic interest
in my proposed Soheme and many others interested themselves
in the project and I was assured that the necessary money to
finance the Scheme would be forthcoming when necessary and I
should have experienced no difficulty whatever in the floșta-
tion of Debenturas amongst the gentleman whom I had approached
on the subject and who were as sanguine as I myself on the
Buccess of the Scheme.
The unfortunate attitude now taken up by the Government
Comitted.
regarding the Scheme has, I fear, become an open secret and it
has had the effect amongst the gentlemen who had originally
agreed to take up Debentures of making them apathetic towards
the Scheme and the Public have also formed the opinion that the
Goverment has decided to withdraw ite former proffered assist-
I have no alternative therefore but to ask that the matter
be referred to the Secretary of State with copies of the docu-
ments and correspondence which have passed between the Government
of this Colony and myself (-hich are sent herewith) and to
intimate to you that I am despatching a copy of this letter and
copies of the former letters and documents on the aubject
direet to the same quarter with the hope that the admitted
desirability of making suitable provision for the housing of
the poorer classes at Home who are unable to help themselves
may be applied to similar clasmon resident in this Colony and
that any Scheme which is designed for the furtherance of this
object should receive the cordial support of my Colonial
Government even to the extent of making a free grant of land
and advancing to the Promoters money on easy terme for develop-
ment and construction, repayable gradually out of the rente
received from the tenants of the houses,

I am directed to inform you that His Excellency the Governor has had under consideration your letter of the 19th. November relative to the terms imposed by this Government in respect of the lease of an area which it is desired to take up for
the purposes of a Portuguese Reservation.
2. His Excellency is in sympathy with the objects of the Scheme, and he cannot agree with your contention that this
Government has adopted a hostile attitude towards it. After full
consideration of the points raised in your letter under reply “hi he is prepared to recommend the lease to the Secretary of State
for the Colonies subject to the modifications shown in the revised draft regulations which are enclosed herewith. His Excellency
hopes that you will be able to see your way to accept the terms
now proposed.
3. With regard to the concluding paragraph of your letter, as it was hoped that a satisfactory arrangement might
still be arrived at, the copies of documents and correspondence
which have passed between this Government and yourself have not
been forwarded to the Secretary of State pending this further
reference to you.

1209/1912 dated 28th. ultimo.
I gladly accept His Excellency's assurance that he is in sympathy with the objects of the scheme and that he is prepared to recommend the Lease to the Secretary of State for the Colonies subject to the modifications shown in the revised draft regulations which are enclosed in your letter under reply. I have perused these regulations, and accept same subject to an agreed limit being placed on the expenditure of the lessees under the last paragraph of clause H and also subject to the water which it is proposed to supply to the Reserved Area being filtered water. I fe- -el sure that His Excellency will not consider that the lessees are unreasonable in desiring to know what their expenditure may be before works commence for connecting storm water drains etc., to the city sewerage, more especially as in the original conditions submitted by the Government under K this expenditure was estimat- -ed to amount to $8,000 and such a sum if added to the enhanced price now agreed upon for the land would in the opinion of the lessees form too great a burden on the scheme,
I note that the correspondence so far exchanged between the Government and myself has not been submitted to the Secretary of State, and I beg leave to express the hope that the matter may now be referred home as expeditiously as possible, more especially as arrangements have been made for the work to commence, if such can be arranged, before the return of the
writer from home.
I note from the postscript of your letter that the Secretary of State has decided that with regard to compensation for tenants improvements at the pairation of leases the principale

With reference to your letter of the 2nd, of March,
I am directed to inform you that no definite estimate of the expenditure to be incurred under Clause H of the Conditions on sewers and storm water drains required outside the boundaries of "The Reserved Area" can be made at present. Possibly a sum of $15,000 might be sufficient, but this figure can only be regarded as a guess.
As regards the water supply the cost is put at £30,000 which includes $15,000 for filter beds.
I enclose a copy of a letter, which was addressed by the Chamber of Commerce to the Government, and a copy of the reply which was sent.

I have the honour to confirm my cypher tele- -gram of the 3rd. instant of which a paraphrase is enclosed and to transmit herewith copy of a map shewing the proposed French Rail- -way Line and the projected British Railway Line with which the French line would clash.
It is obvious that a Railway debouching at Pakhoi would seriously injure the trade of Hongkong and that it is very necessary that the proposed British Line connecting Szema.o with Wuchow and the West River should receive all possible support.
On the 3rd. instant I posted to His Majesty's Minister at Peking copy of the paraphrase of my telegram to you.

Secretary of State dated 3rd. April, WAY¡A!
I have information of the signature at Peking of a
preliminary agreement granting a concession for the construction
of a railway from Yunnanfu to Poseh, Hanning and Pakhoi to a
French Syndicate:
The section of this Railway from Poseh to Manning would forestall a proposal made by Macdonald & Co., a British firm in
Hongkong, for the construction of a line to Possh, Nanning and
Wuchow from Saamo which would attract trade to longkong and to
the West River.
The French Concession should therefore be opposed. If it
is too late to do this, Macdonald & Co. are ready to change their
route so as to go straight from Poseh to Wuchow, and in the
interests of longkong trade this proposal should be strongly
supported.
