all his examinations for the Bar and he obtained a first
class in all of them. He passed his intermediate examina-
-tions in Law in 1897. He has still 4 terms of dinners to
keep, and if he goes on leave at the end of the year he
will be called to the Bar in June next. In this connection
the AttorneyGeneral has advised me as follows:- "There is
not so far as I can see any legal impediment to the
appointment of a Barrister instead of a Solicitor to the
post of Crown Solicitor in Hongkong. The posts of
Solicitor and Assistant Solicitors to the Treasury at
home as also that of Solicitor to the Board of Inland
Revenue, are all held by Barristers and it was the subject
of express enactment”. Mr. Rees-Davies added in conversa-
-tion that if any question should arise as to Mr. Kemp's
acting in the capacity of a Solicitor of the Supreme Court,
the matter could be validated by Ordinance.
If Mr. Kemp were selected it
would be necessary to appoint an Officer to act for him as
he proceeds on leave as above stated at the end of the
year. I consider that Mr. G. H. Wakeman would be a good
appointment to so act.
(3). To appoint Mr. G. H. Wakeman, Land Officer
and Official Receiver. Mr. Wakeman is a Solicitor of the
Supreme Court in England. He was appointed Land Officer in
1900 and his record of service is in the Civil Service
List. He was educated at Bradfield College and
College, Cambridge. He was admitted Solicitor of the
Supreme Court, England, after 4 years articles in October,
1891. He practised as a Solicitor with the Firm of Wake-
-man and Bleek at Warminster from 1891 to April, 1896; and
with the Firm of Wade and Wade of Saffron Waldon, and
London, from May, 1896, to June 1897. Was admitted partner
in his father's Firm at Warminster in January, 1898. Mr.
Wakeman states that he has had considerable experience in
all branches of a Solicitor's profession, including Supreme
Court, County Court, Magisterial, Local Government,
Conveyancing and General work.
Mr. Wakeman is a thoroughly capable
Officer, who as Land Officer has given entire satisfaction
to the Government and to the public. I have had no
opportunity of judging how far he is qualified to fulfil
the manifold duties of Crown Solicitor. I have consulted
the Attorney-General and the Crown Solicitor on the point.
They inform me that as far as they can form an opinion
from his work as Land Officer and Official Receiver they
see no reason to doubt that he would fill the post
efficiently. The Attorney-General, however, considers Mr.
Mr. Kemp the more capable officer. In this opinion I myself
concur and I would point out that Mr. Kemp is the senior

in point of service of the two Officers. Failing Mr.
Bowley and Mr. Kemp I recommend the appoint of Mr. Wakeman.
If Your Lordship decides to appoint him, I recommend that
Mr. Jacks, Assistant Land Officer, be appointed Land Officer
and that an Assistant Land Officer who should be a
Solicitor well qualified in conveyancing be appointed in
Mr. Jacks's place. I enclose the usual paper of particu-

With reference to the 9th. para-
-graph of my Confidential Despatch of this date, I have
the honour to inform Your Lordship that in years gone bye
it was the practice for the Police Department to take
charge of cases in the Police Court for extradition of
fugitive criminals from China. Gradually the practice
sprang up of the Chinese Authorities engaging Solicitors
to prosecute these cases. After a time this led to com-
-plaints by the Chinese Authorities of the expense
involved, and the Government arranged that the Police
should again conduct the prosecutions. Subsequently
there was another relapse to the system under which the
Chinese Authorities engaged Solicitors in private practice
to prosecute. The Firm of Solicitors employed was not of
a high class and in a case in 1905 a questionable
transaction by which a witness for the defence in an
extradition case was caused to disappear from the Colony,

came to light. About the same time the Chief Justice
held in an extradition case which came before him in the
Supreme Court that in Court the Chinese Government had no
locus standi.
Thereupon this Government, being
desirous to prevent extradition proceedings being conduct-
-ed by Solicitors not of the highest standing arranged to
permit the Crow Solicitor to prosecute in extradition
cases under the Chinese Extradition Ordinance and to
receive fees for so doing. The Chinese, it should be
mentioned, wished that a lawyer should prosecute in these
cases. They were not satisfied with the Police prosecuting
probably because these cases are often defended.
These cases have recently and
owing probably to the greater energy in suppressing piracy
and robbery in the neighbouring Provinces of China be-
"come much more numerous than heretofore; and if it is
desired that under the new system now proposed the Crown
Solicitor should continue to prosecute in these cases, an
Assistant Crown Solicitor on a salary of the third class
at present $420 to £540
should be appointed as it is
impossible that the work could be done by the Officers in
the amalgamated Department above recommended. In such case
the fees received from the Chinese Government would be
paid into the Treasury. In 1907 the fees received by the
Crown Solicitor's Firm for these cases were $1,990,in 190#
$2,401, and in 1909 $8,158. The number of cases in 1909
was abnormal. Theywere conducted by the brown Solicitors partner - Mr H. Z. Dennys.
I think, however, that the better
solution would be that the Chinese Government should be
allowed to engage their own Solicitors, subject to the
approval of this Government, to prosecute in extradition
cases and that the Police should watch the cases on behalf
of this Government.
To remove all doubt as to the
locus standi of the Chinese Government in the Courts the
Chinese Extradition

been qualified in a recent case heard before the Full
Court on Habeas Corpus when the Acting Chief Justice and
Mr. Justice Gompertz granted audience to Counsel appearing
for the Chinese Government upon the authority of certain
precedents in England and here which were not wholly
before Sir Francis Piggott in 1905.

Mr. H. J. Watson, a permanent post was found for Mr. R. H.
A. Craig as 1st. Clerk in the Mercantile Marine Office at

1 bare examined the decompanylag Ordinance, entitled
An Ordinance to amend the Crown Lands Resumption Ordinance,
1900, and to make special provision for the Resumption of
Crown Lands of small value for public purposes
and I am of opinion that the Ordinance is one which is not contrary to the Governor's
Instructions,
Crow It is desired to simplify the machinery provided by The Lands Resumption Ordinance 1900 (No. 10 of 1900) in the case of Crown Land in the New Territories resumed by the Government for public purposes which is of small value i.e. which in the opinion of the Governor is under the value of $500.
The Principal Ordinance (No. 10 of 1900) in the case of re- sumption of land requires four months notice to be given and publica- -tion of such notice in the Gazette (sec. 3) and the Board of Arbitra- -tors consists of a Judge of the Supreme Court and two other members (sec. 4) a notification of the constitution of the Board having to be
published in the Gazette (sec. 5),
This Ordinance substitutes one month's notice to the owner of the land which if he cannot be found is, following the Principal Ordinance, to be affixed upon a conspicuous part
of the land to be resumed. It does not require a notice in the
Gazette which in the New Territories is I understand seldom seen,
and the Board of Arbitrators is to consist of a Magistrate or a
Justice of the Peace nominated by the Governor and two other --
members one nominated by the Governor and the other by the owner
of the land.
These changes are effected by sections 3, 4 and 5 which are
to apply in lieu of sections 3, 4 and 5 of the Principal Ordiname
Section 6 gives a general power of entry upon the land when notice of intended resumption has been given whetherTM under the Principal Ordinance or this Ordinance.
Section 7 provides for the payment of compensation in the case of an absent ower. Considerable hardship has been entailed in some instances under the Principal ́Ordinance owing
to the owner being away from the Colony indefinitely, and his whereabouts being unknown and payment having to be withheld from

has furnished on the control of Junks and Boats, with
suggestions for the keeping of statistics of trade, to-
-gether with a precis of the recommendations made. I also
enclose a subsequent Memorandum by Mr. Percebois on the
subject of the control of Steam-launches.
The report first referred to is
almost entirely devoted to a consideration of the means
of giving effect to the proposed arrangements with the
Imperial Maritime Customs, and I do not therefore propose
to comment on his recommendations at present except to say
that they go further than is proposed in the draft con-
-vention which accompanied Sir F. D. Lugard's Confidential
Despatch of the 28th. of April.

Lighters and Cargo Boats.
Lighters and Cargo Boats leaving the waters of
the Colony will deposit their "Junk Certificate of Registry",
in which their Licence is incorporated, with the Harbour Office
and receive in exchange a "Special Clearance" for which a fee
of $1.00 should be charged. This Special Clearance will be valid
for one trip only. Hitherto lighters and cargo boats have traded
under a "Junk Licence" which is half the fee of a "Lighter
Licence" granted under Sub-section 16 of Section 4 of Ordinance
No. 16 of 1906. This Sub-section 16 should be repealed or
amended. Vide page of Report.
A Lighter passing a chinese Imperial Customs
Station without a Special Clearance is to be dealt with jointly
by the Harbour Master and the Commissioner of Customs.
Fishing Junks.
Fishing Junks should, as stated, also be provided
with a Junk Certificate of Registry incorporating the Fishing
ricence. The number of the Licence to be painted on each side of
the centre of the hull and across the sail. They are not to be
allowed more than two rifles with 50 rounds each. No curing of
fish taking place on board they are not to carry salt except for
the use of the crew according to a fixed scale.
Fishing Junks are to enter and clear at Sub-
-sidiary Stations, the same as Trading Junks.
Fishing *Buy Fish" Boats going to and coming
from the fishing grounds are to be considered as Trading Junks
and should enter and clear each trip.

Fees for Licences.
A comparative table of the fees for licences now
levied with proposed alteration will be found on page No. 16
of this Report.
It is suggested that the fee for Trading Junks
be raised by $3.00 all through the scale to compensate for the
loss of Revenue caused by the withdrawal of the "Special
Permits".
The Fishing Licences should be at the same rate
as that for Fish Drying Hulks. It is a moderate increase and
which will cause no hardship especially whan it is considered
that fishing junks are capable of drying fish when at anchor or
underweigh where no control is possible.
Licences for Lighters, Cargo and Water Boats,
also for Fish Drying Hulks remain on the same scale.
Register of Tees Received.
The multiplicity of Forms of Licences, etc.,
being abolished by the "Junk Certificate of Registry", two
Registers are required for the Audit Department to account for
the fees received by the Harbour Master for the issue and
renewal of Junk Certificate of Registry and Licences. For this
control, Audit Registers are necessary, pro-forma of which
are submitted.
Subsidiary Harbour Stations.
The work at these Stations will not be material-

Office Staff.
For The the present the clerical staff is ample to
cope with the work of inaugurating the keeping of the Statistics
of the Trade of the Colony. At the outset the Government only
need to record the Total Quantities and Value of the Trade
passing through the Colony, later it may be desirable or
necessary to have tabular Returns with divisions of the trade
on the same system as that of the Chinese Imperial Maritime
Customs, then it may be necessary to increase the staff. The
proposals now made provide for the keeping of the fuller returns
that will be eventually required, but are capable of adjustment
to any limits the Government may think desizable.
I would strongly recommend that the Junk Office and
Entry and Clearance Office for steamers be centralized under
the authority of the Superintendent of Imports and Exports
leaving to the Harbour Department the control of shipping as far
as Harbour Regulations, Maritime Laws, and other technical
branches are concerned. Such work to be dealt with by the
Harbour Master exclusively with his Secretariat Staff of three
Chinese Clerks who should be under his immediate supervision
and more specially under that of the Assistant Harbour Master.
The European Clerk - until recently Mr. McIver but
now Mr. Lenfestey - should be under the immediate orders of the
Superintendent of Imports and Exports to whom he will be
responsible for the proper working of the Junk Office and Clear-
-ance Office for European Shipping, the keeping of correct
statistics, and all clerical work connected with his department.
The issue of Junk Registers and Licences, requiring
the Harbour Master's signature, to be prepared, as has been the
practice, at the Junk Office and sent to the Harbour Master for
signature but these documents must also be initialed by the
Superintendent of Imports and Exports.

The Junk Inspectors should continue to be under the Harbour waster, but as shown on page 24 of my report, their
work must in a measure subserve that of the Imports and
Exports Office. It does not appear to me that any increase in
the Staff is required for such additional work as a rem
-grouping of office duties and keeping of statistics may entail
but there would seem to be room for more effective supervision
and handling of the Clerical Staff.

As a Preamble to this report on the Junk Traffic and
before entering into the "Modus Operandi" I cannot do better
than to quote from the Memorandum addressed to the Government
on the 31st. March of this year by Mr. A. H. Harris, Commission-
-er of Customs. It reads as follows:-
"As regards the numbering and licensing of junks I
venture to think that there appears to be some con-
-fusion and duplication. Junks # may bear two numbers
and carry two classes of certificates. Certificates
arc issued at several offices and apparently without
relation to each other and without knowledge of the
class of Certificates already possessed and Junkmen
are only too ready to hide çertificates when it suits
their purposes. The undersigned suggests that every
Junk, certainly every Junk above a given minimum
size, should possess a "Birth certificate" correspond-
-ing with the number painted or better still Branded
on every such vessel. The "Birth or Registration
Certificate should only record essential particulars,
e.g. size, rig, owner, master's name, number of crew,
amount of arms carried, address of owner and of
guarantor, etc., the vessels history in brief and a
legal document required in case of sale, mortgage,
etc. Such a certificate is found, but not as yet
complete in every detail, in the Customs Pass Book.
This Book might be improved, renamed and adopted by
the Government and by the Customs jointly and serve
as a Register or Certificate which must always be
with the Junk. In addition to this Register any
Trading, Fishing, or other licence can be issued to
bear the same bumber as the Register and the issue of
which should be noted in the Register. The Register (and its corresponding Office Record) should only
be prepared and issued by the Central Office, the
Imports and Exports Office, but a subsidiary licence

could be issued by any District Station and the fact
noted in the Register. The necessity to report on
each occasion of arrival in harbour that has now
arisen will involve a recasting of the Government's
scales of foes, these being now arranged under two
chief classes and of widely different amounts but
this work although tedious should not prove difficult
and I do not see that the Treasury need be involved
in any loss under this Junk's foes heading."
I will now detail the procedure with a brief
criticism under three headings:-
Trading Junks.
Lighters and Cargo-boats.
Fishing Junks.
I have touched on Lighters and Cargo-boats
because, in some instances, a number of them are working under
a Trading Junk Licence, in order to escape the higher scale of
Lighter and Cargo-boat fees.
Trading Junks.
There are two kinds of Trading Junks:
Unlicensed and Licensed.
Unlicensed Junks take out a Measurement Certifi-
-cate giving name of Junk, Measurement, lames of owner and of
master with residences, ■ name of agents (in Kangkong), number £
of crew, armament and scales of fees for unlicensed Junks per
voyage. For this certificate a fee of $1.00 is levied and it is
valid during the whole of the Junk's existence. The number of
the Certificate is branded on the junk's hull.

The fee for renewal of the Measurement Certifi-
-cate in case of loss or defacement is $0.50 but if wilfully damaged or lost $5.00 is charged.
A Trading Junk Licences which gives name of
Junk, Owner's and Master's names with residences, number of
crew, armament, and conditions of licence, but no measurement
particulars
- is valid for one year (for fee levied, see comparative Table of Fees given on sheet No./5 of this Report).
The number is not branded but is painted on hull.
An Unlicensed Junk in possession of a Measurement
Certificate may take out a Trading Lunk Licence for its
convenience and retain the Heasurement Sertificate: this expl-
explains how a Junk may be marked with tw? different numbers

It sometimes happens that a Junk, for want of funds, is unable
to renew its Trading Junk Licence on the due date. In such a case
a Measurement Certificate is procuded and a Port Clearance
taken out for that trip by paying the necessary fees. The
Trading Junk Licence Number is not erased and the Trading
Licence may be renewed when convenient. This if far from a
satisfactory arrangement.
In my report on the system of collection of duti-
-es upon intoxicating Liquors - under *Remarks and Suggestions"

if anchored at Victoria - or at the District Officers Office
if acnhored at Yaumati, Shaukiwan, Aberdeen, Shamshuipo, and
other places in the New Territories Cheung Chau, Tai O, Sal
-kung, Tai-po, and Deep Bay.
Junks under an Annual Trading Licence are
granted a monthly special Permit" under Sub-section 10 of
Section 39 of the Merchant Shipping Consolidation Ordinance
10 of 1899. With this monthly permit these junks are free
to go and come as they please, without practically any control
as they need not report during the validity of their "Special
Permit" to any Harbour or District Office.
With such freedom of movement clandestine
trade is an easy matter and an amendment to Ordinance 10 of
1899 is necessary by which the junka trading under "Special
Permits" should be made to report their arrivals to the
authorities and have such "Special Permits" vised each trip".
Sub-section 10 reads as follows: -
"The Harbour Master, or the Officer for
the time being in charge of any Harbour Master's
Station, may from time to time on payment of the
prescribed fee, grant to any master of a Junk a
permit, to be called a "Special Permit", which shall
be a sufficient warrant or authority for the doing
of any act mentioned in such permit.
The special permit reads as follows: -
"This permit is granted under Sub-Section 10 of
Section 39 of the Merchant Shipping Consolidation
Ordinance 10 of 1899 to................

"This Permit is to be in force till.

goes to sea"É.
The fee for this permit is $0.25 for one
month. On the back of the "Special Permit" the movement of the Junk are required to be filled in by owner and/or master but
the entries even if made, which is a rare event, are entirely
unreliable; such entries are never verified since the junk has entire freedom from supervision. From these unreliable entries
a periodical summary is made to be embodied in the Harbour
Master's yearly report on Shipping.
This "Spedial Permit" practically nullifies
all the obligations as laid down in Sub-Section 7 and 9 and
makes the Harbour Master or a subordinate supreme above the
legal obligations of the Ordinance. This, it may be surely
presumed, was not intended. Apart from other considerations i.e.
Trade Statistics and Police control, in the igserest of the
Revenue on Liquors it is imperative that Sub-section 10 of
Section 4 of Ordinance 16 of 1906 be amended. Perhaps, I might
say, not so much the Sub-Section in iåself as the wording of the
*Special Permit", for Special Permits will be needed but their
objects can be defined in the Ordinance.
I would suggest a recasting of the Section
and that the Special Permit" be amended as follows:-

Lighters and Cargo-Boats.
It is intended and inferentially stated
that a Lighter and/or a Cargo-Boat Licence entitles such a vessel to go to and fro in the waters of the Colony and to con-
-fine its trading within these limits. There is good reason
to believe that a number of Lighters and Cargo-boats have been
allowed to gradul17 replace their Lighter Licences by a Trading
Licence while continuing to carry on the same trade in the harbour. I may have been misinformed. I find, however, that
Cargo-boats licences are yearly decreasing in numbers (The Harbour Master's report for 1909 shows a decrease of about
100). Junks that formerly took out a Lighter Licence now work
under a Trading Junk Licence at half the cost with the advantage
of being able to do double work, illicitly of course, but the
want of a proper and regular control gives them this advantage.
